LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) ACT, 1963, (MISCELLANEOUS) (AMENDMENT) REGULATIONS, 1967. The Minister for Local Government in exercise of the powers conferred on him by sections 10 and 21 of the Local Government (Planning and Development) Act, 1963 , (No. 28 of 1963) hereby makes the following Regulations:— 1. These Regulations may be cited as the Local Government (Planning and Development) Act, 1963 , (Miscellaneous) (Amendment) Regulations, 1967. 2. The Local Government (Planning and Development) Act, 1963 (Miscellaneous) Regulations, 1964, shall be amended by the deletion of article 3 and the substitution therefor of the following:— "3.

(1)The prescribed documents for the purposes of paragraph (a) of subsection
(1)of section 21 of the Act shall be— (
  1. a)in relation to the authorities prescribed at (
  2. a)to (
  3. j)in sub-article
(2)of this article— (
  1. i)a copy of the written statement comprised in any draft of a proposed development plan, or of proposed variations of a development plan, and (
  2. ii)a copy of the notice of the preparation of the draft published in accordance with paragraph (
  3. b)of the said subsection, and (
  4. b)in relation to the authority prescribed at (
  5. k)in sub-article
(2)of this article— (
  1. i)a copy of the written statement comprised in any draft of a proposed development plan, or of proposed variations of a development plan for any area which comprises or in which is included any place which is or is in an area determined to be a Gaeltacht area by order under section 2 of the Ministers and Secretaries (Amend) Act, 1956 and (
  2. ii)a copy of the notice of the preparation of the draft published in accordance with paragraph (
  3. b)of the said subsection for any such area.
(2)The prescribed authorities for the purposes of paragraph (a) of subsection
(1)of section 21 of the Act shall be— (
  1. a)Every planning authority whose area is contiguous to the area of the planning authority which prepared the draft, (
  2. b)Every local authority in the area to which the draft relates, (
  3. c)An Chomhairle Ealaíon, (
  4. d)Bord Fáilte Éireann, (
  5. e)An Taisce—the National Trust for Ireland, (
  6. f)The National Monuments Advisory Council, (
  7. g)The Minister, (
  8. h)The Minister for Industry and Commerce, (
  9. i)The Minister for Lands, (
  10. j)The Minister for Defence, (

EXPLANATORY NOTE. These Regulations amend the Local Government (Planning and Development) Act, 1963 (Miscellaneous) Regulations, 1964, in relation to the prescribed documents to be sent and the prescribed authorities to whom they are to be sent, in pursuance of section 21 of the Local Government (Planning and Development) Act, 1963 , by a planning authority that has prepared a draft of a proposed development plan under that Act, or a draft of proposed variations of such a development plan. The amendment includes a provision whereby the Minister for the Gaeltacht becomes a prescribed authority in relation to prescribed documents for any area which includes any place in a Gaeltacht area.
