PIGS AND BACON ACTS, 1935 TO 1961 (PIGS AND BACON COMMISSION) DAMAGE ALLOWANCE (NO. 1) ORDER. 1967. WHEREAS sub-section 1 of Section 59 of Part IV of the Pigs and Bacon Act, 1937 (No. 23 of 1937) (hereinafter for brevity called the Act of 1937) provides that the Pigs Marketing Board may, whenever and so often as it thinks fit, by Order do all or any of the following things, that is to say : 1.(
4. a)Define what injury or injuries to a non-factory purchased pig shall constitute damage to such pig for the purposes of such Order and fix, in respect of any such pig which is suffering from damage within the meaning of such Order, the sum to be allowed in respect of such damage. (
5. b)Define what injury or injuries to the carcase of a factory purchased pig shall constitute damage to such carcase for the purposes of such Order and fix, in respect of any such carcase which is suffering from damage within the meaning of such Order, the sum to be allowed in respect of such damage. (
6. c)Define what injury or injuries to the carcase of a non-factory purchased pig shall constitute damage to such carcase for the purposes of such Order and fix, in respect of any such carcase which is suffering from damage within the meaning of such Order the sum to be allowed in respect of such damage, and may fix different sums in respect of different kinds of damage. AND WHEREAS Sub-section 2 of the said Section 59 of the Act of 1937 provides, that the Board may, at any time, by Order under this Sub-section, revoke or amend any Order made under this Section (including this Sub-section). AND WHEREAS Section 22 of the Pigs and Bacon (Amendment) Act, 1939 provides that on and after the transfer date (1st day of January, 1940) the several powers and duties under the Acts of 1935and 1937 which immediately before the transfer date were exercised or performed or capable of being exercised or performed by the Pigs Marketing Board, shall be and are by virtue of the said section transferred to and conferred and imposed on the Pigs and Bacon Commission. AND WHEREAS the Commission has decided to revoke the Damage Allowance Order now in force, namely the Pigs and Bacon Acts, 1935 to 1940 Damage Allowance (No. 1) Order, 1941. AND WHEREAS the Commission has decided to make an Order pursuant to the provisions of Section 59 of the Act of 1937. NOW THEREFORE THE PIGS AND BACON COMMISSION HEREBY ORDERS:— 1. This Order may be cited as " The Pigs and Bacon Acts, 1935 to 1961 (Pigs and Bacon Commission) Damage Allowance (No. 1) Order, 1967 ". 2. In this Order the expression " the Act of 1937 " means the Pigs and Bacon Act, 1937 (No. 23 of 1937) and subject as aforesaid, and unless the contrary intention appears, every word and every expression used in this Order shall have the same meaning as it has in the Acts under which this Order is made. 3. The Pigs and Bacon Acts, 1935 to 1940 Damage Allowance (No. 1) Order 1941 shall be and is hereby revoked as from the time this Order comes into force. 4. This Order shall come into force on the 8th day of May, 1967 and shall continue in force until otherwise ordered by the Commission. 5. The injuries specified in the first column of the Schedule hereto shall constitute damage to a non-factory purchased pig for the purposes of this Order and of Part IV of the Act of 1937 and the amount specified in the second column in the said Schedule immediately opposite the description of the damage shall be the amount to be allowed in respect of such damage. 6. The injuries specified in the first column of the Schedule hereto shall constitute damage or injury to the carcase of a factory-purchased pig for the purposes of this Order and of Part IV of the Act of 1937 and the amount specified in the second column in the said Schedule immediately opposite the description of the damage shall be the amount to be allowed in respect of such damage. Provided alwaysthat this clause shall not apply to any injury suffered by a factory-purchased pig or the carcase of a factory purchased pig after the pig is delivered at the factory of the licensee and such injury shall not constitute the carcase a damaged carcase within the meaning of this Order or of Section 59, Sub-section
