AmendmentsLeasuithe S.I. No. 55 of 1969. SOCIAL WELFARE (PRESCRIBED FEMALE RELATIVE) (TRANSITIONAL) REGULATIONS, 1969. The Minister for Social Welfare in exercise of the powers conferred on him by sections 3 and 66 of the Social Welfare Act, 1952 (No. 11 of 1952) hereby makes the following Regulations :— 1. These Regulations may be cited as the Social Welfare (Prescribed Female Relative) (Transitional) Regulations, 1969. 2. In these Regulations " the Acts " means the National Health Insurance Acts, 1911 to 1952, or the Widows' and Orphans' Pensions Acts, 1935 to 1952, as the context requires. 3. In applying the provisions contained in sections 9 and 10 of the Social Welfare (Miscellaneous Provisions) Act, 1968 (No. 31 of 1968), in relation to an increase of pension in respect of a prescribed female relative— (
4. a)" insurable employment " shall include employment prior to 5th January, 1953, which was insurable under the Acts, (
5. b)" employment contributions " shall include contributions paid under the Acts in respect of insurable employment, (
6. c)" contribution year " shall include a contribution year as defined for the purposes of the Acts for any period prior to 7th July, 1952, and (
7. d)the period from 7th July, 1952, up to and including 5th July, 1953, shall be deemed to be a contribution year. EXPLANATORY NOTE. Sections 9 and 10 of the Social Welfare (Miscellaneous Provisions) Act, 1968 (No. 31 of 1968) contain provisions enabling an incapacitated person receiving old age pension, either contributory or noncontributory, or, being a widow aged 70 or over, contributory widow's pension to be paid an increase of pension in respect of a prescribed female relative who resides with him or her for the purpose of providing full-time care and attention, subject to certain conditions. One of these conditions is that the prescribed female relative must have left insurable employment and have had not less than 156 employment contributions paid in a prescribed period. These Regulations enable employment prior to the 5th January, 1953, which was insurable under the National Health Insurance Acts, 1911 to 1952, or the Widows' and Orphans' Pensions Acts, 1935 to 1952, and employment contributions paid under those Acts, to be taken into account for the purpose of satisfying this condition.
