MERCHANDISE MARKS (RESTRICTION ON IMPORTATION OF PLUMBERS' BRASSFOUNDRY AND COMPRESSION COUPLINGS) ORDER, 1970. I, PATRICK J. LALOR, Minister for Industry and Commerce, having considered a report of the Merchandise Marks Commission under section 7 of the Merchandise Marks Act, 1931 (No. 48 of 1931), on an application for a restriction on importation order in relation to goods specified in Part I of the Schedule to this Order, and having complied with section 14 of that Act, hereby, in exercise of the powers conferred on me by section 8 of that Act (as amended by section 7 of the Merchandise Marks Acts, 1970 (No. 10 of 1970)), order as follows:— 1. This Order may be cited as the Merchandise Marks (Restriction on Importation of Plumbers' Brassfoundry and Compression Couplings) Order, 1970. 2. This Order shall come into operation on the 1st day of May, 1971. 3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 4. Subject to paragraph 6 of this Order, the importation into the State of goods imported by way of trade of the description specified in Part I of the Schedule to this Order is hereby prohibited unless they bear at importation an indication of origin marked on the goods and consisting of the name in English of the country in which the goods were manufactured. 5. An indication of origin marked on goods pursuant to this Order shall be:— ( a ) indelible, ( b ) in letters of a conspicuous size, and ( c ) cast, embossed or impressed on the goods. 6. This Order shall not apply to goods which are shown to the satisfaction of the Revenue Commissioners to be goods referred to in Part II of the Schedule to this Order. SCHEDULE Paragraphs 4 and 6 PART I Goods to which this Order applies Ref. No. 1. Tube and pipe fittings which are of the compression type, are made of copper, brass, bronze or gunmetal and are of an internal diameter not exceeding at any opening 2½ inches. 2. The following classes of taps (including mixing taps), cocks and valves, when made of copper, brass, bronze or gunmetal and suitable for use with pipes, boiler shells, tanks, vats and the like— ( a ) screw-down valves and screw-down stop cocks (other than flange valves and flange cocks) which are of an internal diameter of not less than ½ inch or more than 2½ inches; ( b ) taps and cocks (other than non-concussive taps and cocks) which are of an internal diameter not exceeding one inch and are suitable for use with baths, sinks, showers or lavatory basins; ( c ) float controlled valves of an internal diameter not exceeding one inch, which are suitable for use with cisterns, but excluding any such articles when designed exclusively for hospital use or for urinals. PART II Goods to which this Order does not apply Ref. No. 1. Compression couplings, gate valves, radiator valves, globe valves or cocks, which are permanently marked with the registered trade mark of the manufacturer as registered in the State. 2. Goods manufactured within the State which are being re-imported. 3. Goods which, owing to their smallness of size, it would not be practicable to mark in accordance with this Order. 4. Goods to which section 37 of the Finance Act, 1932 (No. 20 of 1932), section 18 of the Finance Act, 1938 (No. 25 of 1938), or section 18 of the Finance Act, 1946 (No. 15 of 1946), applies. The Order prohibits the importation of various classes of plumbers' brassfoundry and compression couplings unless they bear the name of the country of origin. The Order does not apply to re-imports, very small articles, articles for international airports and ship-building yards and articles designed for blind persons. Compression couplings and specified classes of valves which bear a manufacturer's trade mark registered in the State are also exempted.
