MERCHANDISE MARKS (RESTRICTION ON IMPORTATION OF ELECTRIC KETTLES AND ALUMINIUM HOLLOWWARE) ORDER, 1970. I, PATRICK J. LALOR, Minister for Industry and Commerce, having considered a report of the Merchandise Marks Commission under section 7 of the Merchandise Marks Act, 1931 (No. 48 of 1931), on an application for a restriction on importation order in relation to goods specified in Part I of the Schedule to this Order, and having complied with section 14 of that Act, hereby, in exercise of the powers conferred on me by section 8 of that Act (as amended by section 7 of the Merchandise Marks Act, 1970 (No. 10 of 1970)), order as follows:— 1. This Order may be cited as the Merchandise Marks (Restriction on Importation of Electric Kettles and Aluminium Hollowware) Order, 1970. 2. This Order shall come into operation on the 1st day of May, 1971. 3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 4. Subject to paragraph 6 of this Order, the importation into the State of goods imported by way of trade of a description specified in Part I of the Schedule to this Order is hereby prohibited unless they bear at importation an indication of origin marked on the goods and consisting of the words "Made in" (or other words in English denoting manufacture) followed by the name in English of the country in which the goods were manufactured. 5. An indication of origin marked on goods pursuant to this Order shall be— ( a ) indelible, ( b ) in letters of a conspicuous size, and ( c ) embossed or impressed on the outside of the base or side of the goods. 6. This Order shall not apply to goods which are shown to the satisfaction of the Revenue Commissioners to be goods referred to in Part II of the Schedule to this Order. SCHEDULE PART I Paragraphs 4 and 6 Goods to which this Order applies Ref. No. 1. Milk cans and milk churns, of aluminium, of a capacity not exceeding 6 gallons and standing classified on the date of the making of this Order in the first column of the Schedule to the Imposition of Duties (No. 159) (Customs Duties and Form of Customs Tariff) Order, 1966 ( S.I. No. 132 of 1966 ), at tariff heading number 76.10 (B). 2. Casks, drums, cans, boxes and similar containers (including rigid tubular containers), of aluminium, of a description commonly used for the conveyance or packing of goods, and standing classified on the date of the making of this Order in the first column of the said Schedule at tariff heading number 76.10 (C)

  1. Articles of a kind commonly used for domestic purposes, builders' sanitary ware for indoor use, and parts of such articles and ware, of aluminium, being hollowware and standing classified on the date of the making of this Order in the first column of the said Schedule at tariff heading number 76.15 (A).
  2. Articles of aluminium, being vessels and utensils of a capacity not exceeding 6 gallons which are suitable for use in creameries or dairies and standing classified on the date of the making of this Order in the first column of the said Schedule at tariff heading number 76.16 (A).
  3. Electro-thermic domestic appliances, being kettles standing classified on the date of the making of this Order in the first column of the said Schedule at tariff heading number 85.12 (E)
(2). PART II Goods to which this Order does not apply Ref. No.
  1. Articles of a description specified at Ref. No. 2 in Part I of this Schedule of a height not exceeding 100 millimetres and having a greatest cross-sectional dimension not exceeding 75 millimetres.
  2. Fry pans with folding handles fitted with spring clips or locks.
  3. Picnic kettles of a capacity not exceeding three pints with folding handles and with screw-caps on their spouts.
  4. Goods manufactured within the State which are being re-imported.
  5. Goods which, owing to their smallness of size, it would not be practicable to mark in accordance with this Order.
  6. Goods to which section 37 of the Finance Act, 1932 (No. 20 of 1932), section 18 of the Finance Act, 1938 (No. 25 of 1938), or section 18 of the Finance Act, 1946 (No. 15 of 1946), applies. GIVEN under my Official Seal, this 30th day of November,

The Order prohibits the importation of electric kettles and articles of aluminium hollowware unless they bear an indication of the country of origin. The Order does not apply to specified classes of fry pans and picnic kettles, re-imports, articles of certain dimensions, articles for international airports or ship-building yards and articles designed for use by blind persons.
