The Government, in exercise of the powers conferred on them by section 2 of the Adaptation of Enactments Act, 1931 (No. 34 of 1931) (as adapted in consequence of the enactment of the Constitution), and being of the opinion required by that section, hereby order as follows: 1.

(1)This Order may be cited as the Marsh's Library (Adaptation) Order, 1970.
(2)This Order shall come into operation on the 9th day of January, 1970. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 3. In this Order "the Act" means the pre-Union Irish statute passed in the year 1707 and entitled "An Act for settling and preserving a publick library for ever, in the house for that purpose built by his grace Narcissus, now lord archbishop of Armagh, on part of the ground belonging to the archbishop of Dublin's palace, near to the city of Dublin" (6 Anne c. 19 (Ir.)). 4. The Act shall be construed and have effect as if a reference to the Chief Justice for the time being were substituted— (
  1. a)for the reference to judges for the time being (that is to say, lord chancellor, lord chief justices of the courts of Chief-place and Common-pleas and lord chief baron of the Court of Exchequer) contained in section I, and (
  2. b)for the reference to those judges contained in section II. GIVEN under the Official Seal of the Government, this 2nd day of January, 1970. ERSKINE H. CHILDERS. Tánaiste. EXPLANATORY NOTE. The purpose of this Order is to substitute the office of Chief Justice for all the obsolete judicial offices mentioned in the 1707 Act.
