EUROPEAN COMMUNITIES (LOW VOLTAGE ELECTRICAL EQUIPMENT) (No. 2) REGULATIONS, 1976 I, JUSTIN KEATING, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby make the following regulations: 1 Short title 1. These Regulations may be cited as the European Communities (Low Voltage Electrical Equipment) (No. 2) Regulations, 1976. 2 Commencement 2. These Regulations shall come into operation on the 1st day of March, 1976. 3 Costruction 3. These Regulations shall be construed as one with the European Communities (Low Voltage Electrical Equipment) Regulations, 1975 ( S.I. No. 62 of 1975 ). 4 Penalty for importation and sale of electrical equipment 4. Any person who imports, sells or leases, or offers for sale or for lease, electrical equipment in contravention of Regulation 4 of the European Communities (Low Voltage Electrical Equipment) Regulations, 1975, shall be guilty of an offence and shall be liable on summary conviction to imprisonment for a period not exceeding six months or to a fine not exceeding one hundred pounds or to both such fine and such imprisonment. 5 Prosecution of Offences under these Regulations 5. A prosecution for an offence under these Regulations may be brought by the Minister for Industry and Commerce. GIVEN under my Official Seal this 22nd day of January, 1976. JUSTIN KEATING, Minister for Industry and Commerce. EXPLANATORY NOTE. These regulations are supplementary to the European Communities (Low Voltage Electrical Equipment) Regulations 1975 ( S.I. No. 62 of 1975 ) already made, giving effect to the European Communities Council Directive (73/23 EEC) of 19th February, 1973 on the harmonization of the laws of Member States relating to electrical equipment designed for use within certain voltage limits (O.J. No. L 77/29—26.3.1973). They provide for sanctions for breaches of the 1975 regulations.
