THE LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) ACT, 1976, (COMMENCEMENT) ORDER, 1976. The Minister for Local Government, in exercise of the powers conferred on him by subsection
(3)of section 46 of the Local Government (Planning and Development) Act, 1976 , (No. 20 of 1976), hereby orders as follows:—
- This Order may be cited as the Local Government (Planning and Development) Act, 1976 , (Commencement) Order,
- In this Order— "the Act" means the Local Government (Planning and Development) Act, 1976 ; "the Principal Act" means the Local Government (Planning and Development) Act, 1963 (No. 28 of 1963).
- On the 1st day of August, 1976— ( a ) sections 1, 37, 38, 40 and 46 of the Act shall come into operation; ( b ) section 39 of the Act shall come into operation for the purpose of effecting the amendments set out in paragraphs (c), ( f ), (h), (i), ( j ) and (k) of that section; ( c ) section 41 of the Act shall come into operation for the purpose of effecting the amendments set out in paragraphs (a), (c), (e), ( f ) and (g) of that section; ( d ) subsection
(1)of section 43 of the Act shall come into operation for the purpose of effecting the amendments set out in paragraphs (a), (c), (d), (e), ( f ), (g), (h), (
- k)and (
- l)of that subsection; ( e ) section 45 of the Act shall come into operation for the purpose of effecting the repeal of subsections
(2),
(7)and
(10)of section 46 and section 55
(5)of the Principal Act and in paragraph (h) of section 56
(1)of the Principal Act of all the words from "by reference to" to the end of the paragraph. GIVEN under the Official Seal of the Minister for Local Government this 28th day of July, 1976. This Order brings into operation on 1st August, 1976, certain provisions of the Local Government (Planning and Development) Act, 1976 , and brings into operation on that day the repeal of certain provisions of the Local Government (Planning and Development) Act, 1963 .
