LOCAL AUTHORITIES (TRAFFIC WARDENS) ACT, 1975 (SECTION 3) (OFFENCES) (AMENDMENT) REGULATIONS, 1976. The Minister for Local Government in exercise of the powers conferred on him by subsections
(1)and
(6)of section 3 and section 6 of the Local Authorities (Traffic Wardens) Act, 1975 (No. 14 of 1975) as amended by section 74 of the Finance Act, 1976 (No. 16 of 1976) and after consultation with the Minister for Justice hereby makes the following Regulations:— 1.
(1)These Regulations may be cited as the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) (Amendment) Regulations, 1976.
(2)These Regulations and the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) Regulations, 1975 ( S.I. No. 261 of 1975 ) shall be construed together and may be cited as the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) Regulations, 1975 and
- In these Regulations " the Principal Regulations " means the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) Regulations,
- Article 3 of the Principal Regulations is hereby amended by the addition thereto of the following sub-article— "
(5)an offence under section 73 of the Finance Act, 1976 ." 4. There shall be substituted for paragraph (
- b)of article 5 of the Principal Regulations the following paragraph— "(
- b)(
- i)five pounds in respect of the offence under the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ) of not attaching to and carrying on a vehicle in the manner prescribed by those Regulations a licence in respect of the vehicle issued under the Roads Act, 1920, and (
- ii)five pounds in respect of the offence under section 73 of the Finance Act, 1976 , and " GIVEN under the Official Seal of the Minister for Local Government this 10th day of August, 1976. JAMES TULLY, Minister for Local Government. EXPLANATORY NOTE. These Regulations amend the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) Regulations, 1975 ( S.I. No. 261 of 1975 ) by declaring an additional offence to which section 3 of the Local Authorities (Traffic Wardens) Act, 1975 (No. 14 of 1975) applies, viz. the offence under section 73 of the Finance Act, 1976 of not displaying a current tax disc on a vehicle used, parked or otherwise kept in a public place. The Regulations also prescribe at £5 the amount which a person who is liable to be prosecuted for such an offence may as an alternative to the institution of a prosecution pay, within 21 days of the date of the notice.
