WIRELESS TELEGRAPHY ACT, 1926 (SECTION 3) (EXEMPTION OF CERTAIN WIRED BROADCAST RELAY STATIONS) ORDER, 1976. I, CONOR CRUISE O' BRIEN, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 3
(6)of the Wireless Telegraphy Act, 1926 (No. 45 of 1926) (inserted by section 11 of the Wireless Telegraphy Act, 1972 (No. 5 of 1972)) hereby make the following Order: 1.
(1)This Order may be cited as the Wireless Telegraphy Act, 1926 (Section 3) (Exemption of Certain Wired Broadcast Relay Stations) Order, 1976.
(2)This Order shall come into force on the 1st day of October,
- The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.
- In this Order— "licence" means a licence issued by the Minister under the Regulations of 1974 and which is for the time being in force; "licensed area" means an area described in a licence; "relay" means, in relation to television programmes or television programmes and sound programmes, receive the programmes by means of wireless telegraphy apparatus and then convey them by wire from the place of reception to service points, and "relaying" shall be construed accordingly; "the Regulations of 1974" means the Wireless Telegraphy (Wired Broadcast Relay Licence) Regulations, 1974 ( S.I. No. 67 of 1974 ); "service point" means a point in a premises or part of a premises connected by wire to a station and to which television programmes or both television programmes and sound programmes are conveyed by the wire for reception on wireless telegraphy apparatus in the posession of the occupier of the premises or part; "sound programme" means a programme intended for general reception in sound only; "station" means wireless telegraphy apparatus, including any aerials and the wires connected to the service points served by the apparatus, used solely for the purpose of relaying television programmes or television programmes and sound programmes and any apparatus associated with the apparatus aforesaid; "television programme" means a programme intended for general reception in visual images with or without sound.
- Each of the following classes of apparatus for wireless telegraphy is hereby declared to be a class of apparatus for wireless telegraphy to which section 3 of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), is not to apply, namely: ( a ) a wired broadcast relay station, used solely for the purpose of relaying television programmes or television programmes and sound programmes installed within a licensed area and to which, (i) the number of service points connected does not exceed one hundred, and (ii) no service point has been connected after the date of the relevant licence to a place outside the area served by the station on that date, and ( b ) any other wired broadcast relay station which is so used and to which the number of service points connected does not exceed one hundred.
