The Minister for Local Government, in exercise of the powers conferred on him by sections 5 , 18 and 20 of the Building Societies Act, 1976 (No. 38 of 1976) and as respects articles 3 and 4 of these Regulations after consultation with the Minister for Finance, hereby makes the following Regulations:— 1. These Regulations may be cited as the Building Societies Regulations, 1977. 2. In these Regulations, "the Act" means the Building Societies Act, 1976 . 3.
(1)Subject to the provisions of sub-article
(2)of this article, the minimum value of shares in a society which shall have been issued to each of the appropriate persons for the purpose of subsection
(1)of section 18 of the Act and in respect of which written evidence under that subsection shall be produced to the Registrar shall be £10,000 and the total value of such shares shall be not less than £100,000.
(2)In the case of a society which was incorporated before the 5th day of December, 1975, and which satisfies the Registrar that its directors and members are linked by employment by a common employer and its funds are used solely to enable members to acquire houses for their own occupation the minimum value of shares which shall have been issued to each of the appropriate persons for the purpose of subsection
(1)of section 18 of the Act and in respect of which written evidence under that subsection shall be produced to the Registrar shall be £100 and the total value of such shares shall be not less than £1,
- The amount of the deposit which a society shall maintain at the Central Bank pursuant to section 20 of the Act shall be £20,000 or one and one half per cent of the amount due to shareholders and depositors whichever is the greater, but shall not exceed £500,
- The forms in the Schedule hereto, or forms substantially to the like effect, are hereby prescribed to be used for the purposes to which they relate. SCHEDULE. BUILDING SOCIETIES ACT, 1976 . EXPLANATORY NOTE. These Regulations prescribe the amounts which the founders or directors must have invested in a society to which section 18 of the Act applies. The Regulations also prescribe the amount of the deposit which a society must maintain at the Central Bank in compliance with section 20 of the Act. They also prescribe the form of certificates issued by the Registrar under sections 11, 12, 13, 14, 25, 26 and 27 of the Act.
