CONDITIONS OF EMPLOYMENT (POLYESTER YARN PROCESSING) (EXCLUSION) REGULATIONS, 1978. I, GENE FITZGERALD, Minister for Labour, in exercise of the powers conferred on me by sections 29 and 52 of the Conditions of Employment Act, 1936 (No. 2 of 1936), and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1966 ( S.I. No. 164 of 1966 ), and after consultation with representatives of employers interested in the form of industrial work specified in these Regulations and with representatives of workers so interested hereby make the following Regulations: 1. These Regulations may be cited as the Conditions of Employment (Polyester Yarn Processing) (Exclusion) Regulations, 1978. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations. 3. The following form of industrial work, namely, polyester yarn processing as carried on at the premises of Lirelle (Ireland) Limited, Kiltoy, Letterkenny, Co. Donegal is hereby declared to be excluded industrial work for the purposes of sections 34 and 46 of the Conditions of Employment Act, 1936 (No. 2 of 1936). 4. The following provisions shall have effect in respect of the work to which these Regulations relate: ( a ) no shift shall be longer than twelve hours in duration; ( b ) no worker shall work on two consecutive shifts; ( c ) no worker shall work on shift unless at least twelve hours have elapsed since she last worked a shift; ( d ) no such worker shall work for so many hours in any week that the average number of hours per week worked by her in any four consecutive weeks would exceed forty-two; ( e ) each worker shall be allowed in each shift; (
- i)at least twenty minutes rest which shall commence not less than three nor more than four hours after the commencement of such shift, and (
- ii)at least thirty minutes rest which shall commence not less than seven nor more than eight hours after the commencement of such shift; ( f ) no woman shall be employed to do any such work at any time between the hours of 10 p.m. and 7 a.m. on the following morning; ( g ) no woman shall be so employed on any day until the expiration of eleven hours from the time at which she ceased to do industrial work on the previous day. GIVEN under my Official Seal, this 7th day of July, 1978. GENE FITZGERALD. Minister for Labour. EXPLANATORY NOTE. The Conditions of Employment Act, 1936 provides that female workers may not be employed on industrial work between the hours of 10.00 p.m. on any day and 8.00 a.m. on the following day. The Act also prohibits the working of shifts of longer than nine hours duration on industrial work. The effect of these regulations is to permit the employment of adult females on 12-hour shifts between 7.00 a.m. and 7.00 p.m. on polyester yarn processing as carried on at the premises of Lirelle (Ireland) Ltd., Kiltoy, Letterkenny, Co. Donegal.
