AmendmentsLeasuithe S.I. No. 326 of 1979. SOCIAL WELFARE (OCCUPATIONAL INJURIES) (AMENDMENT) (No. 2) REGULATIONS, 1979. The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952 ) and by sections 1 , 8 , 9 and 13 of the Social Welfare (Occupational Injuries) Act, 1966 (No. 16 of 1966), hereby makes the following Regulations:— 1.
(1)These Regulations may be cited as the Social Welfare (Occupational Injuries) (Amendment) (No. 2) Regulations, 1979.
(2)The collective citation, the Social Welfare (Occupational Injuries) Regulations, 1967 to 1979, includes these Regulations. 2. In these Regulations— "the Principal Regulations" means the Social Welfare (Occupational Injuries) Regulations, 1967 ( S.I. No. 77 of 1967 ); "the Regulations of 1979" means the Social Welfare (Occupational Injuries) (Amendment) Regulations, 1979 ( S.I. No. 99 of 1979 ). 3.
(1)This article shall have effect on and from the 1st day of October, 1979.
(2)Article 4 of the Principal Regulations is hereby amended— ( a ) by the substitution in sub-article
(2)(a) of "£18.60" for "£17.60" (inserted by the Regulations of 1979), and ( b ) by the substitution in sub-article
(2)(b) of "£8.45" for "£7.45" (inserted by the Regulations of 1979). 4.
(1)This article shall have effect on and from the 5th day of October, 1979.
(2)Article 9 of the Principal Regulations is hereby amended— ( a ) by the substitution in sub-article (
- a)of "£9.40", "£4.70" and "£14.10", respectively, for "£8.80", "£4.40" and "£13.20" (inserted by the Regulations of 1979), and ( b ) by the substitution in subarticle (
- b)of "£18.80" for "£17.60" (inserted by the Regulations of 1979). 5.
(1)This article in so far as it relates to disablement gratuities shall have effect on and from the 1st day of October, 1979 and in so far as it relates to weekly rates of pension in lieu of disablement gratuities shall have effect on and from the 5th day of October, 1979.

- i)The Second Schedule to the Principal Regulations is hereby amended by the substitution, for the scale (inserted by the Regulations of 1979) set out in that Schedule, of the scale set out in the Schedule to these Regulations. (
- ii)The weekly rate of pension specified in column
(3)of the scale set out in the Schedule to these Regulations shall have effect on and from the 5th day of October, 1979, whether the period taken into account by the assessment began on, before or after that date.
- Notwithstanding article 5 of these Regulations, the amount of a disablement gratuity payable by virtue of that article shall be payable only where the period taken into account by the assessment of the degree of disablement begins on or after the 1st day of October,

- CHARLES J. HAUGHEY, Minister for Social Welfare. EXPLANATORY NOTE. The Regulations amend the Social Welfare (Occupational Injuries) Regulations, 1967 ( S.I. No. 77 of 1967 ) by increasing the rates of injury benefit payable to persons under age sixteen, increasing the amount of disablement gratuities which are appropriate to degrees of disablement below 20%, the weekly rate of pension which may be substituted therefor and also by increasing the rates of constant attendance allowance. The new rates are payable from appropriate dates in October,
