DUBLIN TRAFFIC AND PARKING BYE-LAWS, 1980. I, PATRICK McLAUGHLIN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by sections 89 and 90 (as amended by section 6 of the Road Traffic Act, 1968 (No. 25 of 1968)) of the Road Traffic Act, 1961 (No. 24 of 1961), with the consent of the Minister for the Environment and after consultation with the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin, the council of the county of Dublin, the corporation of Dun Laoghaire and the commissioners of the town of Balbriggan, hereby make the following bye-laws in respect of the area comprising the county borough of Dublin, the borough of Dun Laoghaire, the county of Dublin and the town of Balbriggan: 1. These bye-laws may be cited as the Dublin Traffic and Parking Bye-Laws, 1980. 2. In these bye-laws "the principal bye-laws" means the Dublin Traffic and Parking Bye-Laws, 1976 ( S.I. No. 83 of 1976 ). 3. Bye-law 2
(1)of the principal bye-laws is hereby amended— ( a ) by the addition of the following definitions:— "'bus lane' has the meaning assigned to it by article 2 of the Road Traffic (Signs) (Bus Lane) Regulations, 1979 ( S.I. No. 413 of 1979 ); 'contra-flow bus lane' has the meaning assigned to it by article 2 of the Road Traffic (Signs) (Bus Lane) Regulations, 1979 ( S.I. No. 413 of 1979 ); 'pedestrian crossing complex' has the meaning assigned to it by article 2 of the Road Traffic (Signs) (Amendment) (No. 2) Regulations, 1979 ( S.I. No. 329 of 1979 )", and ( b ) by the substitution of the following definition for that of "grass margin": "'grass margin' means that portion of a public road which is situated on either side of the footway and is provided for the growing of grass, trees or shrubbery of any kind;". 4. Bye-law 6
(1)of the principal bye-laws (which specifies certain vehicles to which certain prohibitions or restrictions on parking on roadways imposed by Part II of those bye-laws do not apply) is hereby amended by the substitution of the following paragraph for paragraph (f): "a vehicle parked ( other than in a meter parking place or a loading bay) merely while goods are being loaded in or on to or unloaded from it, except where the vehicle is within 45 feet (on the approach side) of a pedestrian crossing or pedestrian lights or is on any part of a pedestrian crossing complex.". 5. Bye-law 6 of the principal bye-lawsis hereby amended by the insertion of the following paragraph after paragraph 2: "
(3)Notwithstanding paragraph
(1)(f) or
(1)(g) of this bye-law, a vehicle shall not be parked on the part of a roadway immediately adjacent to either side of a median strip for the purpose of enabling goods to be loaded in or on to it or unloaded from it or for the purpose of enabling a passenger to enter or leave it.". 6. Bye-law 7 of the principal bye-laws, which specifies conditions for parking is hereby amended by the substitution of the following paragraph for paragraph
(2): "
(2)While a vehicle is parked on a roadway on which there is no restriction on parking, it shall comply with the conditions specified in paragraphs
(1)(a) to
(1)(f ) of this bye-law.". 7. Bye-law 7 of the principal bye-laws is hereby amended by the insertion of the following paragraph after paragraph 3: "
(4)( a ) This paragraph applies to an area specified in a notice caused by the Commissioner of the Garda Síochána to be published in at least one newspaper circulating in the area, or to a public road specified in a notice caused by the Commissioner of the Garda Síochána to be published in at least one newspaper circulating in the area in which the road is situated, and shall apply for such period as may be specified in the notice. ( b ) Except as otherwise indicated by means of a traffic sign, a vehicle shall not. during such period as may be specified in an appropriate notice under this paragraph, be parked on a public road in an area to which this paragraph applies or on a public road to which this paragraph applies, if the unladen weight of the vehicle exceeds that specified for the purposes of this clause in that notice. ( c ) This paragraph shall come into operation, in relation to a particular area or public road specified in a notice under this paragraph, on such date (not earlier than one month after the date of publication of the notice) as may be specified in the notice. ( d ) This paragraph does not apply to a vehicle of a class specified in paragraph
(1)(e),
(1)(f) or
(1)(g) of bye-law 6 of these bye-laws. ( e ) In this paragraph "vehicle" includes a vehicle attached to a mechanically propelled vehicle (or to another vehicle attached to a mechanically propelled vehicle), a vehicle constructed or adapted for the purpose of being drawn by a mechanically propelled vehicle, the drawn component of an articulated vehicle and a vehicle constructed or adapted for use as such drawn component.".
- Bye-law 8 of the principal bye-laws, which specifies places on public roads where parking is prohibited, is hereby amended by the substitution of the following paragraph for paragraph (f): "( f ) on a pedestrian crossing or at pedestrian lights or within 45 feet (on the approach side) or 15 feet (on the side other than the approach side) of a pedestrian crossing or pedestrian lights or on any part of a pedestrian crossing complex.".
- The following bye-law is hereby substituted for bye-law 9 of the principal bye-laws: "9.
(1)A vehicle shall not be parked either wholly or partly on a grass margin or a median strip.
(2)A vehicle shall not mount or cross a median strip.
(3)Paragraph
(1)of this bye-law does not apply to a vehicle specified in paragraphs
(1)(c),
(1)(d),
(1)(e),
(1)(h) or
(1)(j) of bye-law 6 of these bye-laws.". 10. Bye-law 15
(2)of the principal bye-laws, which specifies the circumstances in which the prohibition on parking on clearways imposed by bye-law 15
(1)does not apply, is hereby amended by the substitution of the following for sub-paragraph (a): "( a ) on a holiday, except as otherwise indicated by means of an information plate erected below a clearway sign,". 11. Bye-law 17 of the principal bye-laws, which relates to parking in meter parking places, is hereby amended by the substitution of the following paragraph for paragraph
(3): "
(3)This bye-law shall not apply to a parking bay when the parking meter for that parking bay is temporarily suspended from operation under section 90
(3)(b) (viii) of the Road Traffic Act, 1961 .". 12. Bye-law 20 of the principal bye-laws, which prohibits the depositing of goods on roadways or footways, is hereby amended by the insertion of the following paragraph after paragraph 3: "
(4)( a ) This paragraph applies to a container which contains, or is intended to contain, refuse, rubble or similar material and is so constructed as to be capable of being attached to, or lifted by, a vehicle to facilitate the removal of the container from a roadway or footway. ( b ) A person shall not deposit, or allow to remain, a container to which this paragraph applies, on a roadway or footway during a period when vehicles are required to be lighted unless the container is so lighted as to be clearly visible, and does not cause any danger to other road users. ( c ) A person shall not deposit, or allow to remain, a container to which this paragraph applies, on a clearway at a time which is a clearway period for that roadway, or on a footway adjoining a clearway at such a time." 13. The principal bye-laws are hereby amended by the insertion of the following Part after Part VI: "Part VII BUS LANES Application of Part VII. 23. This Part applies to a street or portion of a street which has been prescribed by traffic sign as a bus lane or as a contra-flow bus lane. Prohibition on entry to or parking on bus lanes. 24.
(1)A person shall not enter, with a vehicle other than an omnibus, a street or portion of street to which this Part applies.
(2)A person shall not park a vehicle in a street or portion of street to which this Part applies. Non-application of Part VII. 25. This Part does not apply to— ( a ) any vehicle which is being used in connection with— (
- i)the removal of any obstruction to traffic, (
- ii)the maintenance, improvement or reconstruction of a street or portion of a street to which this Part applies, (iii) the provision, alteration or repair of a sewer, or of any main, drain, pipe or apparatus for the supply of gas, water or electricity or any telegraph or telephone line, or ( b ) a fire engine, an ambulance or any vehicle in the service of the Garda Síochána while being used in pursuance of statutory powers of duties.". GIVEN under my hand, this 13th day of February, 1980. PATRICK McLAUGHLIN, Commissioner of the Garda Síochána. The Minister for the Environment in exercise of the power conferred on him by section 6 of the Road Traffic Act, 1961 hereby modifies the foregoing bye-laws by the deletion therefrom of bye-law 7 and approves of the said bye-laws as so modified. These bye-laws amend the Dublin Traffic and Parking Bye-Laws, 1976 ( S.I. No. 83 of 1976 ) to introduce regulatory provisions for bus lanes, contra-flow bus lanes and pedestrian crossing complex, to extend the control of median strips and redefine grass margin, to extend the control of vehicles parked in unrestricted parking areas on public roads, to provide that clearway controls be extended to include public holiday periods, to introduce a new provision for what are commonly known as "rubble containers" when placed on public roads, and to amend bye-law 17 of S.I. No. 83 of 1976 (the principal bye-laws).
