HARBOUR RATES (WATERFORD PORT AND HARBOUR) ORDER, 1981. I, ALBERT REYNOLDS, Minister for Transport, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), and after due compliance with section 106 of that Act, hereby order as follows: 1.
(1)This Order may be cited as the Harbour Rates (Waterford Port and Harbour) Order, 1981.
(2)This Order shall come into operation on the 10th day of April,
- In this Order "Great Britain" includes the Channel Islands and the Isle of Man.
- The rates set out in the First Schedule to this Order are hereby fixed as the maximum goods rates to be charged by the Waterford Harbour Commissioners in respect of Waterford Port and Harbour: Provided that, save as otherwise provided in that Schedule, all goods exported from Waterford Port and Harbour shall be charged one half of the goods rates to be charged by the said Waterford Harbour Commissioners.
- The rates set out in the Second Schedule to this Order are hereby fixed as the maximum tonnage rates to be charged by the Waterford Harbour Commissioners in respect of Waterford Port and Harbour.
- The Harbour Rates (Waterford Port and Harbour) Order, 1980 ( S.I. No. 84 of 1980 ), is hereby revoked. FIRST SCHEDULE. RATES ON GOODS CHARGEABLE ON GROSS WEIGHT, INCLUDING PACKAGES. - On every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, of every vessel discharging or loading cargo or passengers, for each time of entering the Harbour— ( a ) From or to any port in the State, Northern Ireland or Great Britain 39.69p ( b ) From or to any port or place in Europe between the River Elbe and Brest 51.03p ( c ) From or to any port or place not in the State, Northern Ireland or Great Britain nor in Europe between the Elbe and Brest 56.70p
- On every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, of every vessel entering the Harbour for the purpose of seeking shelter therein or for repairs or for orders and not discharging or loading cargo or passengers 1.68p
- On every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, of every fishing vessel of twenty five tons net register tonnage or over which is, for the time being, employed in sea fishing or the sea fishing service, for each time such vessel enters the Harbour and does not load fish but makes use of the quays and wharves 25.20p Laying up charges
- In accordance with Bye-Law 74(a) and (b) of the Bye-Laws relating to navigation within the limits of the Port. On every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, of every vessel laid up in Waterford Harbour for each week or part of a week 8.40p Local lights rates
- For and upon every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, of every vessel which having entered the Port from the sea comes up same. 6.804p GIVEN under my Official Seal, this 2nd day of April,
