AmendmentsLeasuithe I, ALBERT REYNOLDS, Minister for Transport, in exercise of the powers conferred on me by Section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), and after due compliance with Section 106 of the said Act, hereby order as follows: 1.

(1)This Order may be cited as the Harbour Rates (Cappa Pier at Kilrush) Order, 1981.
(2)This Order shall come into operation on the 26th day of June, 1981. 2.
(1)The rates set out in the Schedules to this Order are hereby fixed as the maximum rates to be charged by the Kilrush Urban District Council in respect of Cappa Pier at Kilrush.
(2)Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows:- (
  1. a)any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes, (
  2. b)any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes, (
  3. c)any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall count as 750 kilogrammes, (
  4. d)any weight exceeding 750 kilogrammes but not exceeding 1 tonne, shall count as 1 tonne. 3. The Harbour Rates (Cappa Pier at Kilrush) Order, 1978 ( S.I. No. 353 of 1978 ), is hereby revoked. FIRST SCHEDULE GOODS RATES Commodity Unit of Quantity Rate All goods per tonne 8p SECOND SCHEDULE TONNAGE RATES Ref. No. Description of Charge Rate 1 On every ton of the net register tonnage, or of half the gross tonnage, whichever is the greater, of every vessel entering the pier. 8p THIRD SCHEDULE OTHER CHARGES Ref. No. Description of Charge Rate 1. For every tonne of goods deposited on the pier and not removed within 48 hours, a sum per day, or part of a day not exceeding 3p 2.
