No. 318/1981 - Circuit Court Rules (No. 4), 1981 (Publication of Sittings of the Dublin Circuit Court) AmendmentsLeasuithe WE, THE CIRCUIT COURT RULES COMMITTEE, constituted pursuant to the provisions of Section 69 of the Courts of Justice Act, 1936 , and Section 12 of the Courts of Justice Act, 1947 , by virtue of the powers conferred on us by Section 66 of the Courts of Justice Act, 1924 , and Section 70 of the Courts of Justice Act, 1936 (as applied by Section 48 of the Courts (Supplemental Provisions) Act, 1961 ) and Section 27 of the Courts (Supplemental Provisions) Act, 1961 , and of all other powers enabling us in this behalf, do hereby, with the concurrence of the Minister for Justice, make the annexed Rules of Court. Dated the 4th day of September, 1981. JIM MITCHELL Minister for Justice CIRCUIT COURT RULES (No. 4) 1981 (PUBLICATION OF SITTINGS OF THE DUBLIN CIRCUIT COURT) 1. These Rules which may be cited as the Circuit Court Rules (No. 4) 1981 shall come into operation on the 30th day of September 1981. 2. The Order referred to in these Rules as being amended is contained in the Circuit Court Rules, 1950 as amended. 3. Order 1 shall be amended by inserting after Rule 1 the following Rule:— 1A. This Rule applies to the Dublin Circuit only. The President of the Circuit Court if assigned to the Dublin Circuit or the Senior Judge of the Dublin Circuit if the President is not assigned to that Circuit shall direct and appoint the times and place for the Sittings of the Circuit Court in the Dublin Circuit. Notice of such Sittings shall be published in Iris Oifigiúil not later than two months before the date thereof. The said notice shall set out the day of commencement and the day of termination of each Sitting. Provided that the President of the Circuit Court if assigned to the Dublin Circuit or the Senior Judge of the Dublin Circuit if the President of the Circuit Court is not assigned to the Dublin Circuit may with the consent of all the Judges permanently assigned to the Dublin Circuit extend any Sittings of the Circuit Court in the Dublin Circuit beyond the date of termination of that Sittings. It will not be necessary to publish any notice of such extension. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) These Rules, which amend Order 1 of the Circuit Court Rules, 1950 and which apply to the Dublin Circuit Court only, provide that the commencement date and the termination date of the Dublin sitting be published in “Iris Oifigiúil” not later than two months before the date thereof, and that sittings of the Circuit Court in Dublin may be extended beyond the stated date of termination and that it will not be necessary to publish notice of such extension.
