AmendmentsLeasuithe I, PATRICK COONEY, Minister for Transport, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ) and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ) and after due compliance with section 106 of that Act, hereby order as follows: 1.

(1)This Order may be cited as the Harbour Rates (New Ross Harbour) Order, 1981.
(2)This Order shall come into operation on the 8th day of December, 1981. 2. In this Order— “the Order of 1980” means the Harbour Rates (New Ross Harbour) Order, 1980 ( S.I. No. 28 of 1980 ); 3. The Harbour Rates (New Ross Harbour) Order, 1949 ( S.I. No. 230 of 1949 ), is hereby amended by— (
  1. a)The substitution for the First Schedule (inserted by the Order of 1980) thereto of the following Schedule: “FIRST SCHEDULE ACTUAL GOODS RATES Commodity Unit of Quantity Import/Export Rate Acid per tonne 37p Ammonia “ ” 37p Animal Feed “ ” 18p Coal “ ” 11p Crude Fertilisers “ ” 22p Grain “ ” 22p Machinery “ ” 135p Malt “ ” 22p FBU Cars and Vans per vehicle 203p CKD Cars per tonne 49p Petroleum Products “ ” 49p Potash “ ” 27p Pulpwood “ ” 14p Salt “ ” 27p Timber “ ” 54p Cement “ ” 27p Miscellaneous except otherwise herein scheduled “ ” 42p ” (
  2. b)the substitution for the Second Schedule (inserted by the Order of 1980) thereto of the following: “SECOND SCHEDULE ACTUAL TONNAGE RATES Ref. No. Description of Charge Rate 1. Tonnage rates on vessels other than those described in paragraphs 2 to 7 below inclusive: (
  3. a)On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel discharging or loading in the harbour ... 37.5p (
  4. b)On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel entering and leaving the harbour without cargo, or entering and leaving the harbour with the same cargo, or for the purpose of seeking refuge ... ... ... ... ... ... 15p (
  5. c)On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel lying up in the harbour after the expiration of 2 days for each succeeding week or part thereof 15p 2. On every river craft which plies regularly between any points in Waterford harbour and New Ross harbour or within the limits of New Ross harbour an annual sum payable yearly in advance on the 1st January of: ... ... ... ... ... £30.00 3. On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel, barge or lighter constructed in New ross and exported through the port to any port or place ... ... ... ... ... ... 37.5p 4. On every passenger-carrying vessel, other than seagoing passenger vessels, operating in the Port of New Ross an annual sum payable in advance on the 1st January of: ... ... ... ... £37.50 5. On every hired Cruiser entering or ieaving the Port of New Ross a sum of: ... ... ... ... £3.00 6. On every pleasure craft entering or leaving the Port of New ross an annual sum payable in advance on 1st January of: ... ... ... ... £4.50 ” (
  6. c)the substitution for the Third Schedule (inserted by the Order of 1980) thereto of the following: “THIRD SCHEDULE ACTUAL SERVICE RATES Ref. No. Description of Charge Rate 1. For mooring or unmooring ships at the Commissioners' wharves and jetties, per ship ... £15 2. For the attendance of the Harbour Constable at loading or unloading of hazardous cargos £7.50 per hour or so much of the remuneration of the Constable as is attributable to the time spent by him in attendance during the loading or dsicharging whichever is the greater sum. 3. For the provision of fresh water at the Commissioners' wharves ... ... ... 60p per 5,000 litres together with any labour charges incurred. 4. Wharfage Rates At the Commissioners' permanent wharves and jetties ... ... ... ... ... 50% of the appropriate goods rate ” and (
