AmendmentsLeasuithe I, SEÁN DOHERTY, Minister for Justice, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and section 1 of the Garda Síochána Act, 1958 (No. 14 of 1958), hereby with the approval of the Government make the following Regulations:— 1.
(1)These Regulations may be cited as the Garda Síochána (Appointments) Regulations, 1982.
(2)The Garda Síochána (Appointments) Regulations, 1945 to 1981, and these Regulations may be cited together as the Garda Síochána (Appointments) Regulations, 1945 to 1982. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations. 3.
(1)Notwithstanding anything in the Garda Síochána (Appointments) Regulations, 1945 to 1981, whenever the Minister for Justice is of opinion that, having regard to the number of persons seeking to be appointed and enrolled as members of the Garda Síochána, it is impracticable for the Surgeon of the Garda Síochána to examine within a reasonable time all such persons for the purpose of certifying the matters specified in Article 4
(1)(b) (inserted by the Garda Síochána (Appointments) Regulations, 1981 ( S.I. No. 202 of 1981 )) of the Garda Síochána (Appointments) Regulations, 1945 (S. R. & O., No. 173 of 1945), and in Article 4
(1)(b) (as so inserted) of the Garda Síochána (Appointments) Regulations, 1958 ( S.I. No. 176 of 1958 ), the Minister may nominate (for such period as may be specified in such nomination) a registered medical practitioner (within the meaning of the Medical Practitioners Act, 1978 (No. 4 of 1978)) to examine such persons and to certify the aforesaid matters.
(2)A certificate issued under this Article shall be deemed to be a certificate issued by the Surgeon of the Garda Síochána under the Garda Síochána (Appointments) Regulations, 1945 to 1982.
(3)Whenever, after an examination carried out by a registered medical practitioner nominated by the Minister for Justice under paragraph
(1)of this Article, a person, in respect of whom the Commissioner of the Garda Síochána has been notified before the commencement of these Regulations by the Civil Service Commissioners that that person has qualified for appointment and enrolment as a member of the Garda Síochána as a result of a competitive interview conducted by the Civil Service Commissioners, is not given a certificate under this Article, that person may, within three months of the date of notification that a certificate will not be issued, apply to be examined by the Surgeon of the Garda Síochána, who, as soon as may be practicable after receipt of the application, shall examine that person.
(4)The provisions of this Article are without prejudice to the powers of the Surgeon of the Garda Síochána under the Garda Síochána (Appointments) Regulations, 1945 to
