S.I. No. 188/1982 - Poisons Regulations, 1982.

(1)In these Regulations— "the Act" means the Poisons Act, 1961 ; "animal" includes fish and poultry; "animal remedy" has the meaning assigned to it by section 2 of the Animal Remedies Act, 1956 (No. 41 of 1956); "authorised person" has the meaning assigned to it by sub-section

(3)of section 2 of the Pharmacy Act, 1962 (No. 14 of 1962); "food" includes a beverage; "health board" means a health board established under section 4 of the Health Act, 1970 (No. 1 of 1970); "local authority" means the council of a county, the corporation of a county or other borough, or the council of an urban district; "the Minister" means the Minister for Health; "registered dentist" means a person registered in the register established under the Dentists Act, 1928 (No. 25 of 1928); "registered druggist" means a person registered in the register of registered druggists in Ireland established under the Pharmacy Act (Ireland), 1875, Amendment Act, 1890; "registered medical practitioner" means a person registered in the register established under the Medical Practitioners Act, 1978 (No. 4 of 1978); "registered veterinary surgeon" means a person registered in the register established under the Veterinary Surgeons Act, 1931 (No. 36 of 1931); "sale by wholesale" means sale to a person who buys for the purpose of selling again and cognate words shall be construed accordingly; "the Society" means the Pharmaceutical Society of Ireland.

(2)In these Regulations— ( a ) any reference to an article or Schedule shall be construed as a reference to an article contained in these Regulations or, as the case may be, to a Schedule thereto and any reference in an article to a sub-article shall be construed as a reference to a sub-article of that article; ( b ) any reference in a Schedule to the percentage of a poison contained in any substance or preparation shall, unless otherwise expressly provided, be construed in the following manner, that is to say, a reference to a substance or preparation containing one per cent. of any poison means— (

1. i)in the case of a solid, that one gramme of the poison is contained in every hundred grammes of the substance or preparation; (
2. ii)in the case of a liquid, that one millilitre of the poison, or, if the poison itself is a solid, one gramme of the poison, is contained in every hundred millilitres of the substance or preparation, and so in proportion for any greater or lesser percentage. 5 Substances declared to be poisons. 5. The substances set out in the First Schedule are hereby declared to be poisons for the purposes of these Regulations. 6 General restrictions on sale of poisons. 6.

(1)Subject to the provisions of these Regulations a person shall not in the course of a business sell— ( a ) any poison set out in Part I of the First Schedule unless he is a person keeping open shop for the dispensing or compounding of medical prescriptions or for the sale of poisons in accordance with the Pharmacy Acts, 1875 to 1977 and the sale is effected by or under the supervision of an authorised person or a registered druggist, or ( b ) any poison set out in Part II of the First Schedule unless— (

1. i)he is a person keeping open shop for the dispensing or compounding of medical prescriptions or for the sale of poisons in accordance with the Pharmacy Acts, 1875 to 1977 and the sale is effected by or under the supervision of an authorised person or a registered druggist, or (
2. ii)he is a person licensed by a health board under article 14 in respect of the premises on which the said poison is sold and the sale is effected by that person.

(2)A person shall not sell a poison from a travelling shop, vehicle or automatic vending machine. 7 Labelling. 7.

(1)Subject to the provisions of these Regulations a person shall not sell or supply a poison unless there is legibly written in a conspicuous position on the container in which the poison is sold or supplied and on every box or other covering of whatever nature enclosing the container— ( a ) the name of the poison in the form prescribed in sub-article

(2), and ( b ) subject to sub-article

(3), where the poison is contained in a preparation as one of the ingredients thereof, a statement of the proportion which the poison bears to the total ingredients of the preparation and, where the proportion is expressed as a percentage, the statement shall indicate whether the percentage is calculated on the basis of mass in mass, mass in volume or volume in volume, and ( c ) subject to sub-article

(4), the word "Poison", and ( d ) subject to sub-article

(5), the name of the seller or supplier and the address of the premises from which the poison is sold or supplied.

(2)Subject to sub-article

(3)and for the purposes of paragraph (a) of sub-article

(1)the name of a poison shall be— ( a ) where the term under which a poison is set out in the First Schedule describes the poison specifically, the said term, or ( b ) where the term under which a poison is set out in the First Schedule describes a group of poisons and not the poison specifically, the accepted scientific name, or the name descriptive of the true nature and origin of the poison.

(3)In the case of a preparation containing a poison set out in the first column of the Sixth Schedule, it shall be sufficient to state the name of the poison or substance mentioned in the second column of that Schedule in respect of which the proportion of the poison to the total ingredients of the preparation is set out in the manner prescribed in the said column.

(4)( a ) The container of any substance set out in the first column of the Seventh Schedule shall, instead of the word "Poison", be labelled with the words set out opposite the description of the substance in the second column of the said Schedule; ( b ) The container of any poison which is an animal remedy shall, instead of the word "Poison", be labelled with the words "For Animal Treatment Only"; ( c ) The words set out in paragraph (

1. a)or (
2. b)of this sub-article or the word "Poison", as the case may be, shall not be modified in meaning by the addition of any other words or marks, and— (
3. i)shall be on a separate label or be surrounded by a line within which there shall be no words except the words with which the container of the poison is required to be labelled under these Regulations, and (
4. ii)in the case of a poison included in the Second Schedule, shall either be in red lettering or be set against a red background.

(5)( a ) The provisions of paragraph (d) of sub-article

(1)shall not apply in the case of a product sold or supplied for the purpose of being sold or supplied again in the same container; ( b ) In the case of a poison sold or supplied from a warehouse or depot it shall be sufficient if the container of the poison is labelled with the address of the supplier's principal place of business or, in the case of a limited liability company, of the company's registered office; ( c ) Where any poison is sold or supplied in the same container and outer covering in which it was obtained by the seller or supplier it shall be sufficient if the name of the seller or supplier and the address of the premises at which it was sold or supplied appear on the outer covering; ( d ) Where more than one name and address appear on a label, there shall also be words on the label indicating clearly which person is the seller or supplier and at which of the addresses the poison was sold or supplied.

(6)( a ) A poison shall not be sold or supplied in liquid form in a bottle of a capacity not exceeding three litres, unless the bottle is labelled with the words "Not to be taken"; ( b ) Compressed hydrogen cyanide shall not be sold or supplied unless the container in which it is sold or supplied is labelled with the words "Warning. This container holds poisonous gas and should only be opened and used by persons having expert knowledge of the precautions to be taken in its use."; ( c ) Salts of paraquat shall not be sold or supplied in liquid form for use as a pesticide unless the container in which it is sold or supplied is labelled with the words "Keep out of the reach of children. Do not re-pack from this container. Destroy container when empty.".

(7)Subject to sub-article

(8)this article shall not require the labelling of any transparent cover, or any wrapper, ham-per, packing case, crate or other covering used solely for the purpose of transport or delivery.

(8)A poison set out in the Eight Schedule shall not be consigned for transport unless there is legibly and conspicuously written on the outside of the package in which the poison is enclosed the name or description of the poison as specified in that Schedule and a notice indicating that it is to be kept separate from food and from empty containers in which food has been or is intended to be contained.

(9)The provisions of this article with the exception of sub-article

(1)(d) as modified by sub-article

(5)shall not apply as respects the sale or supply of a poison contained in a medical preparation— ( a ) which is labelled in compliance with the provisions of article 6 of the Medical Preparations (Advertisement and Sale) Regulations, 1958 ( S.I. No. 135 of 1958 ), or ( b ) which is sold or supplied in the dispensing of a prescription issued by a registered medical practitioner, registered dentist or registered veterinary surgeon. 8 Keeping of books and records. 8.

(1)Subject to the provisions of articles 16 and 19 a poison set out in the Second Schedule shall not be sold to any person unless that person either— ( a ) is certified in writing by a householder in the manner described in sub-article

(3), or ( b ) is known by the seller or by an authorised person or registered druggist in the employment of the seller at the premises where the sale is effected to be a person to whom the poison may properly be sold.

(2)Subject to the provisions of this article the seller of any poison set out in the Second Schedule shall not deliver it until— ( a ) he has entered or caused to be entered in a book kept for that purpose, in the form set out in the Fifth Schedule— (

1. i)the date of the sale; (
2. ii)the name and address of the purchaser; (iii) the name and address of the person, if any, by whom the certificate required under sub-article

(1)(

1. a)was given; (
2. iv)the name and quantity of the poison sold; (
3. v)the purpose for which the poison is stated by the purchaser to be required; and ( b ) the purchaser has signed his name to such entry.

(3)( a ) A certificate given for the purposes of sub-article

(1)(a) shall be in the form and shall contain the particulars set out in the Twelfth Schedule; ( b ) Such a certificate given by a householder who is not known to the seller of the poison to be a responsible person of good character shall not be a sufficient certificate for the said purposes unless it is endorsed in the manner specified in the Twelfth Schedule by a member of the Garda Siochana; ( c ) Any certificate given for the purposes of this article shall be retained by the seller on completion of the sale.

(4)Sub-articles

(1)and

(2)shall apply as respects the supply in the form of a commercial sample, otherwise than on sale, of any poison set out in the Second Schedule in like manner as if references in those sub-articles to the sale and seller of poisons respectively included references to the supply and the supplier of poisons in the form of commercial samples.

(5)Subject to sub-article

(6)so much of sub-article

(2)as requires signature of an entry by a purchaser shall not apply as respects the sale of a poison to a person for the purpose of his trade, business or profession where— ( a ) the seller shall have obtained before the completion of the sale an order in writing signed by the purchaser stating the purchaser's name and address, trade, business or profession, the purpose for which the poison is required and the total quantity to be purchased, and ( b ) the seller is reasonably satisfied that the signature is that of the person purporting to have signed the order and that that person carries on the trade, business or profession stated in the order, being one in which the poison to be purchased is used, and ( c ) the seller inserts in the entry required to be made under sub-article

(2)the words "signed order" and a reference number by which the order can be identified.

(6)Where a person represents that he urgently requires a poison set out in the Second Schedule for the purposes of his trade, business or profession, the seller may, if he is reasonably satisfied that the person so requires the poison and is, by reason of some emergency, unable before delivery either to furnish to the seller an order in writing duly signed or to attend and sign the entry in the book, deliver the poison to the purchaser on an undertaking by the purchaser to furnish such an order within twenty-four hours.

(7)All books kept for the purposes of sub-article

(2)shall be preserved for a period of two years from the date on which the last entry was made therein and shall be kept readily available for inspection by any member of the Garda Sióchana or a person holding a written authorisation for the purposes of article 20.

(8)The provisions of this article shall not apply as respects the sale or supply of any poison by the manufacturer or importer thereof or by a person carrying on a business in the course of which poisons are regularly sold by wholesale where— ( a ) the poison is sold or supplied to a person carrying on a business in the course of which poisons are regularly sold or are regularly used in the manufacture of other products, and ( b ) the seller or supplier is reasonably satisfied that the purchaser requires the poison for the purposes of that business. 9 Restrictions of sales to shopkeepers. 9.

(1)Subject to sub-article

(2)a person shall not sell a poison by wholesale to a person carrying on a business of shopkeeping unless— ( a ) he has reasonable grounds for believing that the purchaser is a person entitled to sell the poison under and in accordance with article 6

(1), or ( b ) he has received a statement signed by the purchaser or by a person acting on his behalf to the effect that the purchaser requires the poison for the purpose of his trade, business or profession and that he does not intend to sell the poison on any premises used for or in connection with his retail business.

(2)Sub-article

(1)(b) shall not apply as respects any poison set out in the Ninth Schedule which is intended for use as a pesticide. 10 Storage. 10.

(1)A poison shall not be stored except in a container impervious to the poison and sufficiently strong to prevent leakage from the container arising from the ordinary risks of handling.

(2)A poison set out in the Second Schedule shall not be stored in any retail shop or premises used in connection therewith unless it is stored— ( a ) in a cupboard or drawer reserved solely for the storage of poisons, or ( b ) on a shelf reserved solely for the storage of poisons and (

1. i)no food is kept directly underneath that shelf, and (
2. ii)the container of the poison is distinguishable by touch from containers of substances and products, other than poisons, stored in the same premises, or ( c ) in a part of the shop or premises which is partitioned off or otherwise separated from the remainder of the shop or premises— (
3. i)to which customers are not permitted to have access, and (
4. ii)in which no food is kept. 11 Containers. 11.

(1)A poison shall not be sold or supplied unless it is contained in a container impervious to the poison and sufficiently strong to prevent leakage arising from the ordinary risks of handling and transport.

(2)A poison set out in the Second Schedule shall not be sold or supplied in liquid form in a bottle of a capacity not exceeding one litre unless the outer surface of the bottle is fluted vertically with ribs or grooves distinguishable by touch.

(3)Sub-article

(2)shall not apply as respects the sale or supply of a poison to a person or institution concerned with scientific education, research or chemical analysis for the purposes of such education, research or analysis. 12 Transport. 12.

(1)A poison shall not be consigned for transport by carrier unless it is sufficiently stoutly packed to avoid leakage arising from the ordinary risks of handling and transport.

(2)A person shall not knowingly transport a poison set out in the Eight Schedule, either on his own behalf or on behalf of another person, in any vehicle in which food is also being transported unless the food is carried in a part of the vehicle effectively separated from that containing the poison, or is otherwise adequately protected from the risk of contamination. 13 Colouring. 13.

(1)Subject to sub-article

(2)a poison set out in the Ninth Schedule which is intended for use as a pesticide shall not be sold unless there has been added to the poison a dye or other substance which renders it of a distinctive colour.

(2)Sub-article

(1)shall not apply as respects— ( a ) a poison which is itself of a distinctive colour, or ( b ) sheep dips which are already of a distinctive colour. 14 Licensed sellers. 14.

(1)A health board may grant licences to persons engaged in selling or offering or keeping for sale poisons, in respect of premises situated within its functional area.

(2)An application for a licence under this article shall be in the form set out in Part A or Part B of the Tenth Schedule as may be appropriate.

(3)A licence under this article shall be in the form set out in Part A or Part B of the Eleventh Schedule as may be appropriate.

(4)A licence under this article shall have effect only as respects poisons set out in Part II of the First Schedule.

(5)A licence under this article shall, unless sooner cancelled or suspended, continue in force for a period of two years.

(6)A licence under this article may specify not more than two persons who may act as responsible deputies on behalf of the licensee and such persons while so specified and acting in the capacity of deputy shall also be licensed under this article.

(7)A fee of £20 shall be charged by a health board in respect of the granting of a licence under this article.

(8)A health board may refuse an application for a licence under this article in the case of a person who— ( a ) fails to pay the appropriate fee, or ( b ) is, in the opinion of the board, for any sufficient reason relating to him personally, or to a person nominated to act as his responsible deputy, or to the premises in respect of which the application is made, not a fit and proper person to be licensed under this article.

(9)A health board may cancel, suspend or restore a licence granted under this article.

(10)The person affected by the decision of a health board to refuse an application for or to cancel or suspend a licence under this article may appeal to the Minister and where such an appeal is successful the health board shall allow the application or shall not cancel or suspend the licence, as the case may be.

(11)A health board shall keep a register of licences granted under this article and any person may, at all reasonable times, on payment of a fee of £2, inspect and make copies of any entry in such register.

(12)Where a health board grants a licence under this article to a person who indicates that he proposes to sell poisons set out in Part III of the Fourth Schedule, the board shall send a copy of the licence to the Registrar of the Society.

(13)For the purposes of sub-article

(8), "relating to him personally" means, in relation to a body corporate, relating personally to the directors, managers or other officers of the body corporate. 15 Restrictions on licensed sellers. 15.

(1)A person shall not by virtue of being licensed under article 14 sell— ( a ) any poison set out in Part II of the First Schedule except in a closed container as closed by the manufacturer or other person from whom the poison was obtained; ( b ) any poison set out in the first column of Part I of the Fourth Schedule unless the substance or product sold is one of the substances or products specified opposite the description of the poison in the second column of the said Part I and the container of the substance or product is, in addition to any other requirement of these Regulations with respect to labelling, labelled clearly with a notice of the special purpose for which the substance or product is intended and a warning that it is to be used for that purpose only; ( c ) any poison set out in Part II of the Fourth Schedule unless the purchaser is engaged in the trade or business of agriculture, horticulture or forestry and requires the poison for the purpose of that trade or business; ( d ) any poison set out in Part III of the Fourth Schedule unless— (i) the sale is effected under the direction and control of an authorised person, a registered druggist or a registered veterinary surgeon specified in the licence, and (ii) the poison consists of or is contained in a preparation intended for use exclusively for the treatment of animals and is labelled clearly with a notice to that effect, and (iii) the poison is intended for administration otherwise than by parental injection, and (iv) the purchaser is engaged in the trade or business of agriculture and requires the poison for the treatment of animals in the course of that trade or business.

(2)A person shall not by virtue of being licensed under article 14 use in connection with the premises to which the licence relates any title, emblem or description reasonably calculated to suggest that he is entitled to sell any poison which he is not entitled to sell. 16 Restriction of sales of strychnine. 16. The provisions of article 8 shall apply to the sale of strychnine, its salts or quaternary compounds or preparations thereof containing 0.2% or more of strychnine as though there were substituted for sub-article

(1)thereof the following— "

(1)Subject to the provisions of articles 16 and 19 strychnine, its salts or quaternary compounds or preparations thereof containing 0.2% or more of strychnine shall not be sold to any person unless— ( a ) that person is certified in writing by a member of the Garda Siochana in the form set out in the Fourteenth Schedule, and ( b ) the quantity of strychnine (calculated as base) sold does not exceed one gramme, and ( c ) the sale takes place within a period not exceeding two weeks from the date of the certificate given for the purposes of paragraph (a)." and any subsequent reference in the said article to a certificate, with the exception of the references in sub-article

(3)(

1. a)and (
2. b)thereof, shall be regarded as a reference to a certificate given for the purpose of the provisions so substituted. 17 Further restrictions on the sale and supply of certain poisons. 17.

(1)Fluoroacetic acid, its salts, fluoroacetamide, salts of thallium or zinc phosphide shall not be sold or supplied except to— ( a ) a Department of State, local authority or health board requiring it for the public service or in connection with the exercise of any statutory powers, functions or duties, or ( b ) a person carrying on a business of pest control for use as a rodenticide.

(2)Embutramide, fluanisone or mebezonium iodide shall not be sold or supplied except to a registered veterinary surgeon for the purpose of his profession as such.

(3)Potassium arsenites or sodium arsenites shall not be sold or supplied except— ( a ) as an ingredient, or for the purpose of being compounded, in a medicine, or ( b ) as an ingredient in a sheep dip or sheep wash in a container clearly labelled with a notice of the special purpose for which the substance is intended and a warning that it is only to be used for that purpose.

(4)Calcium cyanide, potassium cyanide or sodium cyanide shall not be sold or supplied except to— ( a ) a hospital, nursing home, clinic or similar institution for use in the provision of medical, surgical, dental or veterinary treatment, or ( b ) a person who requires it for the purpose of enabling him to comply with any requirements made by or in pursuance of any enactment relating to the medical treatment of persons employed by that person in any trade or business carried on by him, or ( c ) a Department of State, local authority or health board requiring it for the public service or in connection with the exercise of any statutory powers, functions or duties, or ( d ) a person who requires it for the purpose of his trade, business or profession.

(5)Nothing in the foregoing provisions of this article shall apply as respects the sale or supply of a substance or product to a person or institution concerned with scientific education, research or chemical analysis, for the purposes of such education, research or analysis. 18 Record of sales of certain poisons. 18.

(1)Subject to the provisions of these Regulations, the seller of any poison set out in Part III of the Fourth Schedule shall not deliver it until— ( a ) he has entered or caused to be entered in a book kept for that purpose, in the form specified in the Thirteenth Schedule— (

1. i)the date of the sale; (
2. ii)the name and address of the purchaser; (iii) the name, form strength and quantity of the product sold; (
3. iv)the purpose for which the product is stated by the purchaser to be required; and ( b ) the purchaser has signed his name to such entry.

(2)So much of sub-article

(1)as requires signature of an entry by a purchaser shall not apply where— ( a ) the seller shall have obtained before the completion of the sale an order in writing signed by the purchaser stating the purchaser's name and address, the purpose for which the product is required and the form and total quantity of the product to be purchased, and ( b ) the seller is reasonably satisfied that the signature is that of the person purporting to have signed the order, and ( c ) the seller inserts in the entry required to be made under sub-article

(1)the words "signed order" and a reference number by which the order can be identified.

(3)All books kept for the purposes of this article shall be preserved for a period of two years from the date on which the last entry was made therein.

(4)The provisions of this article shall not apply as respects the sale of any substance or product in the dispensing of a prescription issued by a registered medical practitioner or registered dentist. 19 General exemptions. 19.

(1)Nothing in these Regulations shall apply— ( a ) to any poison contained as an ingredient or component in a substance or product set out in Part I of the Third Schedule, or ( b ) in the case of a poison set out in the first column of Part II of that Schedule, to any substance, preparation or product included in the second column of the said Part II opposite the mention of the poison.

(2)The provisions of articles 6 and 18 shall not apply as respects— ( a ) the supply of any poison by a registered medical practitioner for the purposes of medical treatment of a patient under his care, a registered dentist for the purposes of dental treatment of a patient under his care or a registered veterinary surgeon for the purposes of treatment of an animal under his care, or ( b ) the sale of any poison by a person carrying on a business in the course of which poisons are regularly sold either by wholesale or for use by the purchaser thereof in his trade, business or profession to— (

1. i)any hospital, nursing home, clinic or similar institution for use in the provision of medical, surgical, dental or veterinary treatment, or (
2. ii)a person who requires the poison for the purpose of his profession, or (iii) a person carrying on a business in the course of which poisons are regularly used in the manufacture of other products, or (
3. iv)a person who requires the poison for the purpose of enabling him to comply with any requirements made by or in pursuance of any enactment relating to the medical treatment of persons employed by that person in any trade or business carried on by him, or (
4. v)a Department of State or any local authority or health board requiring the poison for the public service or in connection with the exercise of any statutory powers, functions or duties, or (
5. vi)a person or institution concerned with scientific education, research or chemical analysis, for the purposes of such education, research or analysis, or ( c ) the sale by wholesale of any poison by any person in the course of a business carried on by him.

(3)The provisions of articles 6, 7, 9, 11

(2), 13, 17 and 18 shall not apply as respects the sale or supply of any poison to be exported to persons outside the State.

(4)The provisions of articles 7, 10, 11 and 12 shall not apply to any poison where— ( a ) it is a substance to which the European Communities (Dangerous Substances) (Classification, Packaging and Labelling) Regulations, 1979 and 1980 ( S.I. No. 383 of 1979 , S.I. No. 34 of 1980 ) apply, and ( b ) its packaging and labelling are in accordance with the provisions of those Regulations. 20 Enforcement. 20.

(1)The enforcement and execution of the provisions of these Regulations and the prosecution of offences under section 17 of the Act in relation to these Regulations may be carried out— ( a ) by officers of the Minister, ( b ) by the Society and its officers, ( c ) as respects poisons set out in Part II of the First Schedule, by health boards and their officers.

(2)The enforcement and execution of the provisions of these Regulations as respects poisons set out in Part 11 of the First Schedule may be carried out by officers of the Minister for Agriculture.

(3)Subject to sub-articles

(4)and

(5)any such officer as aforesaid (with, in the case of an officer of the Minister or the Minister for Agriculture, a written authorisation of whichever of those Ministers is appropriate, in the case of an officer of the Society, a written authorisation of that Society and in the case of an officer of a health board, a written authorisation of the board) may, at all reasonable times, for the purpose of ascertaining whether or not there is or has been a contravention of these Regulations— ( a ) enter premises of any class or description, ( b ) inspect any substance which is stored or offered or kept for sale at such premises, ( c ) require the production of, and inspect and, if he thinks fit, take copies of any document or of any entry in any book at such premises, and ( d ) take (without payment) samples of poisons or of any substances stored, or offered or kept for sale, at such premises for test, examination or analysis.

(4)Sub-article

(3)shall not apply as respects any of the following premises - ( a ) such part of any premises (not being a shop) as is used by a registered medical practitioner, registered dentist or registered veterinary surgeon for carrying on his practice, or ( b ) a premises used only as a private dwelling.

(5)( a ) So much of sub-article

(3)as enables officers of the Society to enter premises of any class or description shall not apply as respects any of the following premises— (

1. i)a hospital, nursing home, clinic or similar institution; (
2. ii)the premises of a manufacturer of a poison or a person carrying on a business in the course of which poisons are regularly sold only either by wholesale or for use by the purchaser thereof in his trade, business or profession; (iii) a premises in respect of which a licence under article 14 is in force. ( b ) So much of sub-article

(3)as enables officers of health boards to enter premises of any class or description shall not apply as respects any of the following premises— (

1. i)the premises of a manufacturer of a poison or a person carrying on a business in the course of which poisons are regularly sold only either by wholesale or for use by the purchaser thereof in his trade, business or profession; (
2. ii)the premises of a person keeping open shop for the dispensing and compounding of medical prescriptions or for the sale of poisons in accordance with the Pharmacy Acts, 1875 to 1977. 21 Evidence of result of test, examination or analysis 21.

(1)In any proceedings for an offence under section 17 of the Act a certificate signed by— ( a ) the State Chemist, or ( b ) a public analyst appointed under section 10 of the Sale of Food and Drugs Act, 1875, or ( c ) a chemist or analyst appointed by the Society for that purpose, stating the result of any test, examination or analysis of a sample shall, with regard to that sample, be evidence for all purposes of such result.

(2)The certificate referred to in sub-article

These Regulations provide that the retail sale of certain poisons (i.e. those specified in Part I of the First Schedule) may only take place at a retail pharmacy being lawfully conducted under the Pharmacy Acts. The Regulations also provide that certain other poisons (i.e. those specified in Part II of the First Schedule) may be sold by retail outlets licensed for that purpose, as well as through pharmacies. The Regulations impose certain restrictions and obligations in relation to labelling of poisons generally, and in the case of certain poisons specify requirements in regard to record-keeping, packaging, colouring, storage and transport. The Regulations contain special restrictions in relation to the sale of strychnine and certain other substances which are used mainly for pest control. Appropriate exemptions are provided for supply of preparations containing poisons to hospitals etc. and for professional use, or for the purpose of wholesale dealing, export, etc. The Regulations are made under the Poisons Act, 1961 , and will replace a number of provisions contained in earlier enactments which will be repealed when the Regulations come into force.
