SALMON, EEL AND OYSTER (MISCELLANEOUS LICENCES) (ALTERATION OF DUTIES) ORDER, 1982. I, PADDY O'TOOLE, Minister for Fisheries and Forestry, in exercise of the powers conferred on me by section 68 (as amended by section 4 of the Fisheries (Amendment) Act, 1976 (No. 23 of 1976)), section 279
(2)(as amended by the said section 4), and sections 159
(6)(a) and 160
(5)(a) (both inserted by section 69 of the Fisheries Act, 1980 (No. 1 of 1980)) of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 .) (as adapted by the Fisheries (Alteration of Name of Department and Title of Minister) Order, 1978 ( S.I. No. 195 of 1978 )), hereby make the following order with respect to which, pursuant to sections 68
(7)and 279
(4)(both inserted by section 3 of the Fisheries (Amendment) Act, 1976 ) and sections 159
(6)(b) and 160
(5)(b) (both inserted by the said section 69) of the Fisheries (Consolidation) Act, 1959 , a draft has been laid before each House of the Oireachtas and a resolution approving of the draft has been passed by each such House:
- This Order may be cited as the Salmon, Eel and Oyster (Miscellaneous Licences) (Alteration of Duties) Order,
- In this Order— "the Act of 1980" means the Fisheries Act, 1980 (No. 1 of 1980); "the Principal Act" means the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959).
- The ordinary licence duty in respect of a salmon rod ordinary licence of a class specified in column
(2)of Part 1 of the Schedule to this Order at any reference number is hereby altered with effect from the 1st day of January, 1983, to the sum specified in column
(3)of the said Part 1 at that reference number. 4. The ordinary licence duty in respect of an ordinary fishing licence authorising the use of a fishing engine of a kind specified in column
(2)of Part II of the Schedule to this Order at any reference number is hereby altered with effect from the 1st day of January, 1983, to the sum specified in column
(3)of the said Part II at that reference number. 5. The licence duty on each oyster fishing licence is hereby altered with effect from the 1st day of January, 1983, to thirty pounds. 6.
(1)The Principal Act is hereby amended by— ( a ) the substitution in section 159
(1)(b) (ii), as amended by section 69
(1)of the Act of 1980, of "fifty pounds" for "twenty-five pounds"; ( b ) the substitution in section 159
(2)(b) (ii), as amended by the said section 69
(1), of "two hundred pounds" for "twenty-five pounds"; and ( c ) the substitution in section 160
(1)(b), inserted by section 69
(2)of the Act of 1980, of "fifty pounds" for "twenty-five pounds".
