EUROPEAN COMMUNITIES (NON-AUTOMATIC WEIGHING MACHINES) (AMENDMENT) REGULATIONS, 1983. I, Frank Cluskey, Minister for Trade, Commerce and Tourism, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive No. 82/622/EEC of 1 July, 19821 hereby make the following Regulations: 1. These Regulations may be cited as the European Communities (Non-Automatic Weighing Machines) (Amendment) Regulations, 1983. 2. The European Communities (Non-Automatic Weighing Machines) Regulations, 1979 ( S.I. No. 128 of 1979 ), are hereby amended by— ( a ) the substitution in Regulation 2

(1)of the following definition for the definition of "the Council Directive": " 'the Council Directive' means Council Directive No. 73/360/EEC2 of 19 November, 1973 as amended by Commission Directive No. 82/622/EEC of 1 July, 1982;", ( b ) the insertion of the following paragraph in Regulation 3— "

(2)of this Regulation shall be construed subject and without prejudice to section 25 of the Weights and Measures Act, 1878.". ( c ) the substitution of the following paragraph for paragraph
(1)(inserted by the European Communities (Non-Automatic Weighing Machines) (Amendment) Regulations, 1982 ( S.I. No. 297 of 1982 )) of Regulation 5: 1O.J. No. L252,27/8/82, p.2 2O.J. No. L335,5/12/73, p.l "
(1)There shall be charged in respect of each non-automatic weighing machine submitted for EEC initial verification to an inspector under the Weights and Measures Acts, 1878 to 1961, or to an officer of the Institute for Industrial Research and Standards— ( a ) a fee of £0.71 if it is one of the first 50,000 machines so submitted since the 1st day of July, 1983, and ( b ) a fee of £0.45 if it is not one of the first 50,000 machines so submitted since the said 1st day of July,

These regulations are made to give effect to Commission Directive No. 82/622/EEC adapting to technical progress Council Directive No. 73/360/EEC as last amended by Commission Directive No. 76/696/EEC on the approximation of the laws of Member States relating to non-automatic weighing machines. The regulations also set out a revised fee for the EEC initial verification of non-automatic weighing machines.
