I, JIM MITCHELL, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive 82/500/EEC of 7th June, 1982

(1), hereby make the following regulations: 1.
(1)These Regulations may be cited as the European Communities (Radio Interference from Fluorescent Lighting Luminaires) (Amendment) Regulations, 1983.
(2)The European Communities (Radio Interference from Fluorescent Lighting Luminaires) Regulations, 1979 ( S.I. No. 171 of 1979 ), and these Regulations may be cited together as the European Communities (Radio Interference from Fluorescent Lighting Luminaires) Regulations, 1979 and 1983.
(3)These Regulations shall come into operation on the 1st day of December,

In these Regulations: "the Council Directive" means Council Directive 76/890/EEC of 4th November, 1976; "the Commission Directive" means Commission Directive 82/500/EEC on 7th June, 1982; "the Regulations of 1979" means the European Communities (Radio Interference from Fluorescent Lighting Luminaires) Regulations 1979 ( S.I. No. 171 of 1979 ).
  3. The Regulations of 1979 are hereby amended by the substitution for Regulation 7 of the following Regulation: "
  4. Examinations, tests and measurements for the purpose of verifying compliance with the Council Directive shall be in accordance with the provisions of the Annex to the Commission Directive.".

  2. JIM MITCHELL. EXPLANATORY NOTE. The purpose of these Regulations is to give legal effect to Commission Directive 82/500/EEC. This Directive has the effect of replacing the Annex to an earlier Council Directive (76/890/EEC) and was necessary because of improvements to the technical requirements for compliance with the Directive. Both Directives aim at the harmonisation of the laws of EEC member states relating to the suppression of radio interference caused by fluorescent lighting luminaires.
