LOCAL GOVERNMENT REORGANISATION (SUPPLEMENTARY PROVISIONS) (DUBLIN) REGULATIONS, 1985. The Minister for the Environment, in exercise of the powers conferred on him by section 18 of the Local Government (Reorganisation) Act, 1985 (No. 7 of 1985) hereby makes the following Regulations:— 1. These Regulations may be cited as the Local Government Reorganisation (Supplementary Provisions) (Dublin) Regulations, 1985. 2. In these Regulations— "the Act of 1985" means the Local Government (Reorganisation) Act, 1985 ; the expression "the added areas" has the meaning assigned to it by section 9 of the Act of 1985; the expression "the excluded areas" has the meaning assigned to it by section 9 of the Act of 1985. 3. Nothwithstanding the alteration of boundaries affected by section 10 of the Act of 1985— (
- a)section 135
(3)and section 274 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981 ) shall continue to have effect in the excluded areas until the 1st day of August, 1986. (
- b)an establishment order made prior to the commencement of section 10 of the Act of 1985 by the Labour Court under section 39 of the Industrial Relations Act, 1946 (No. 26 of 1946) and which has effect in the added areas or in the excluded areas shall continue (until revoked under section 40 of that Act) to have effect in the added areas or in the excluded areas to the extent that it had effect in those areas; (
- c)the provisions of the Licensing Acts, 1833 to 1983 and the provisions of the Registration of Clubs Acts, 1904 to 1981 and of any order, regulation, rule, bye-law or other instrument or agreement made wholly or partly under any such enactments having effect prior to the commencement of section 10 of the Act of 1985 in the added areas or in the excluded areas shall continue to have effect in such areas respectively; (
- d)the enactments relating to the areas of jurisdiction of the Sheriff for the County Borough of Dublin and the Sheriff for the County of Dublin, so long as any one of the persons who holds one of those offices at the commencement of section 10 of the Act of 1985 continues to hold such office, shall continue to have effect in the added areas and in the excluded areas respectively; (
- e)the provisions of section 6
(1)and section 8 of the Coroners Act, 1962 (No. 9 of 1962) shall continue to have effect in the added areas and in the excluded areas as respects the appointment of Coroners for the Coroners districts in which those areas were comprised prior to the commencement of section 10 of the Act of 1985; (
- f)the provisions of the School Attendance Acts, 1926 to 1967 having effect in the added areas and in the excluded areas prior to the commencement of section 10 of the Act of 1985 shall continue to have effect in the added areas and in the excluded areas respectively, until the 1st day of January, 1986; and (
- g)the provisions of the Weights and Measures Acts, 1878 to 1936 and the provisions of the Merchandise Marks Acts, 1887 to 1978 having effect in the added areas and in the excluded areas prior to the commencement of section 10 of the Act of 1985 shall continue to have effect in the added areas and the excluded areas respectively, until the 1st day of January, 1986. These Regulations provide for the continuation in effect of certain provisions of several enactments in the added areas and in the excluded areas as defined in Section 9 of the Local Government (Reorganisation) Act, 1985 .
