SOCIAL WELFARE (SUPPLEMENTARY WELFARE ALLOWANCES) (AMENDMENT) (No. 2) REGULATIONS, 1985. The Minister for Social Welfare, in exercise of the powers conferred on him by section 209 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981), hereby makes the following Regulations: 1.
(1)These Regulations may be cited as the Social welfare (Supplementary Welfare Allowances) (Amendment) (No. 2) Regulations, 1985.
(2)The collective citation "the Social Welfare (Supplementary Welfare Allowances) Regulations, 1977 to 1985" shall include these Regulations. 2. Article 6 of the Social Welfare (Supplementary Welfare Allowances) Regulations, 1977 ( S.I. No. 168 of 1977 ), as amended by the Social Welfare (Supplementary Welfare Allowances) (Amendment) Regulations, 1985 ( S.I. No. 49 of 1985 ), is hereby further amended by— (i) the substitution with effect from the 7th day of October, 1985 in sub-article
(9)of "£5" for "£4"; (ii) the addition thereto of the following sub-article— "
(11)A fuel allowance may be paid to a person who on the 17th day of February, 1985, was in receipt of an increase of supplementary welfare allowance under section 209
(1)(a) of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981) or of a supplementary welfare allowance under section 209
(1)(b) of that Act for his heating needs and who would, but for the provisions of the Social Welfare (Supplementary Welfare Allowances) (Amendment) Regulations, 1985 ( S.I. No. 49 of 1985 ), have continued to receive such an increase or such allowance." GIVEN under the Official Seal of the Minister for Social Welfare this 3rd day of October

- EXPLANATORY NOTE. The Social Welfare (Supplementary Welfare Allowances) (Amendment) Regulations 1985 ( S.I. No. 49 of 1985 ) prescribed the categories of persons eligible under the scheme for a weekly fuel allowance during the 30 week period beginning on the first Monday in October each year. The categories of persons eligible comprise mainly social welfare pensioners and recipients of analogous payments or basic supplementary welfare allowance who are living alone or only with specified persons and are considered by the local health board to be unable to provide for their heating needs. These Regulations provide that persons who are not in the categories specifically provided for in the earlier Regulations but who received a fuel allowance under the arrangements which existed prior to those Regulations, will, if their circumstances have not changed, continue to be entitled to an allowance. The Regulations also provide for an increase from £4 to £5 in the weekly value of the allowance payable under the scheme with effect from the commencement of the heating season in October
