LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) (EXEMPTED DEVELOPMENT) REGULATIONS, 1987. The Minister for the Environment, in exercise of the powers conferred on him by sections 4 and 10 of the Local Government (Planning and Development) Act, 1963 (No. 28 of 1963), hereby makes the following Regulations— 1. These Regulations may be cited as the Local Government (Planning and Development) (Exempted Development) Regulations, 1987. 2. These Regulations and the Local Government (Planning and Development) Regulations, 1977 to 1985 shall be construed as one and may be cited together as the Local Government (Planning and Development) Regulations, 1977 to 1987. 3. The Local Government (Planning and Development) Regulations, 1977 ( S.I. No. 65 of 1977 ) are hereby amended by the deletion of Class 21 in columns 1 and 2 of Part I of the Third Schedule and the substitution therefor of the following matter— Column 1 Column 2 Description of Development Conditions "CLASS 21 The carrying out— ( a ) pursuant to and in accordance with a consent given by the Minister for Energy under section 8 of the Gas Act, 1976 (No. 30 of 1976) (as amended) by the Irish Gas Board of development consisting of the construction of underground pipelines for the transmission of gas (but not the construction or erection of any apparatus, equipment or other thing anciallary to such a pipeline save cathodic protection equipment and marker posts), or ( b ) pursuant to and in accordance with an order made by the Minister for Energy under section 2 of the Gas (Amendment) Act, 1987 (No. 9 of 1987) by the Irish Gas Board of development consisting of the laying underground of mains, pipes, cables or other apparatus, or ( c ) in accordance with requirements of the Minister for Energy under section 40 of the Gas Act, 1976 , of development consisting of the construction of an underground pipeline for the transmission of gas (but not the construction or erection of any apparatus, equipment or other thing ancillary to a such pipeline save cathodic protection equipment and marker posts), or ( d ) by any gas undertaking (other than the Irish Gas Board) of development consisting of the laying underground of mains, pipes, cables or other apparatus for the purposes of the undertaking."
