EUROPEAN COMMUNITIES (AGRICULTURAL OR FORESTRY TRACTORS TYPE APPROVAL) REGULATIONS, 1988. I, MICHAEL O'KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive 86/298/EEC of 26 May 1986

(1)in so far as that Directive applies to the type approval of agricultural or forestry tractors and components, hereby make the following Regulations:

  2. These Regulations may be cited as the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1988, and shall come into operation on the 15th day of July,
  4. In these Regulations "the Regulations of 1979" means the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1979 ( S.I. No. 137 of 1979 ).
  5. The following Regulation is hereby substituted for Regulation 11 (inserted by the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1980 ( S.I. No. 101 of 1980 )) of the Regulations of 1979: "

The manufacturer of a tractor approved under Regulation 5 of these Regulations shall cause it to be fitted with a roll-over protection structure which satisfies the relevant provisions of the Directive referred to at reference number 11, the Directive referred to at reference number 17 or the Directive referred to at reference number 24 of Schedule I to these Regulations".
  7. Schedule I (inserted by the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1983 ( S.I. No. 270 of 1983 ) and amended by the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1987 ( S.I. No. 297 of 1987 )) to the Regulations of 1979 is hereby amended by the insertion in columns

(4)and
(5)in that Schedule after item No. 23 of the following matter: "24 86/298/EEC 26 May 1986 O.J. No. L186/26 of 8.7.1986 Rear-mounted roll-over protection structures of narrow-track wheeled agricultural or forestry tractors." GIVEN under my Official Seal this 7th day of July, 1988. The Regulations implement the type approval provisions of Council Directive 86/298/EEC relating to rear-mounted roll-over protection structures of narrow-track wheeled agricultural or forestry tractors.
