FUELS (PETROLEUM OILS) (AMENDMENT) ORDER, 1989. I, MICHAEL SMITH, T.D., Minister for Energy, in exercise of the powers conferred on me by section 3
(5)of the Fuels (Control of Supplies) Act, 1971 (No. 3 of 1971), and the Industry and Energy (Alteration of Name of Department and Title of Minister) Order, 1983 ( S.I. No. 385 of 1983 ), hereby order as follows: 1. This Order may be cited as the Fuels (Petroleum Oils) (Amendment) Order, 1989. 2.
(1)Article 7 of the Fuels (Petroleum Oils) (Order), 1983 ( S.I. No. 2 of 1983 ) is hereby amended by the substitution, in paragraph
(1)(inserted by the Fuels (Petroleum Oils) (Amendment) Order, 1986 ( S.I. No. 241 of 1986 )), of the following paragraph for paragraph (b): "(
- b)The Minister shall, in respect of each month of each quarter, determine for the purposes of this Order on an F.O.B. basis the prices per tonne at which the types of petroleum oils required by Article 4 of this Order to be purchased by a person from the Corporation in that quarter shall be so purchased, and— (
- i)the determination in respect of each such month shall relate to such quantity of each such type as bears to the total quantity of that type the same proportion as the number of days in that month bears to the number of days in that quarter, and (
- ii)the prices so determined shall be notified in writing— (I) before the beginning of each month of each quarter to persons whose requirements are determined under clause (
- i)of Article 4
(2)(c), and (II) as soon as reasonably practicable to persons whose requirements are estimated under clause (ii) of the said Article.".
(2)Notwithstanding paragraph
(1)of this Article, a determination made by the Minister under the said Article 7 before the making of this Order in respect of the quarter commencing on the 1st day of April, 1989, shall have effect for that month and for the month of May, 1989, as if made and notified by virtue of this Article, in relation to such quantity of each type of petroleum oil to which the determination relates as bears to the total quantity of that type of petroleum oil the same proportion as the number of days in those months bears to the number of days in that quarter, and such a determination as aforesaid shall not have effect for the month of June, 1989, and, in lieu thereof, the Minister shall make determinations under the said Article 7 by virtue of this Article in respect of that month. The Order applies to persons who import into the State certain petroleum products either for their own use or for disposal in the State. Such persons are obliged to purchase a quantity of petroleum products, refined at the Whitegate oil refinery, from the Irish National Petroleum Corporation Limited. This Order provides for the determination of prices for those products on a monthly basis.
