LOCAL GOVERNMENT EMPLOYEES (WIDOWS AND ORPHANS EX-GRATIA PENSION) (AMENDMENT) SCHEME, 1989. The Minister for the Environment, in exercise of the power conferred on him by sections 2 and 5 of the Local Government (Superannuation) Act, 1980 (No. 8 of 1980), with the consent of the Minister for Finance, hereby makes the following Scheme: 1 Short Title. 1. This Scheme may be cited as the Local Government Employees (Widows and Orphans Ex-Gratia Pension) (Amendment) Scheme, 1989. 2 Commencement. 2. This Scheme shall be deemed to have come into force on the 27th day of May, 1977. 3 Amendments of article 6. 3. The Local Government Employees (Widows and Orphans Ex-Gratia Pension) Scheme, 1984 ( S.I. No. 319 of 1984 ), as amended by the Local Government Employees (Widows and Orphans Ex-Gratia Pension) (Amendment) Scheme, 1987 ( S.I. No. 314 of 1987 ) is hereby amended by the insertion of the following sub-article after article 6

(5): "
(6)Notwithstanding the provisions of sub-article
(5), where the deceased's pension was reduced by virtue of articles 33
(1)(b) and 35 of the Local Government (Superannuation) Act, 1956 (Consolidation) Scheme, 1987 ( S.I. No. 316 of 1987 ) or sections 49
(1)(b) and 51 of the Local Government (Superannuation) Act, 1948 (No. 4 of 1948), the Minister in his absolute discretion may, on application from the relevant local authority, direct that the widow's pension shall be calculated by reference to the deceased's pension as if it had not been so reduced.".
