The Minister for Health, in exercise of the powers conferred on him by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby makes the following Regulations:— 1. These Regulations may be cited as the European Communities (Preservatives in Food) (Purity Criteria) Regulations, 1989. 2.

(2)In these Regulations words and phrases shall have the same meaning as in the Council Directive.
  1. Subject to article 6 of these Regulations, no preservative shall be manufactured, prepared, imported, distributed or sold in the State unless such preservative complies with the specific purity criteria applicable to that preservative in the Council Directive.
  2. A person who contravenes these Regulations shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £500 and, in the case of a continuing offence, to a further fine not exceeding £50 for each day the offence is continued.
  3. These Regulations shall be enforced in the functional area of a health board by the health board.
  4. These Regulations shall not apply to preservatives for export or re-export.
  5. The European Communities (Preservatives in Food) (Purity Criteria) Regulations, 1981 ( S.I. No. 184 of 1981 ) are hereby revoked. GIVEN under the Official Seal of the Minister for Health this 13th day of October,

They revoke and replace the European Communities (Preservatives in Food) (Purity Criteria) Regulations, 1981 ( S.I. No. 184 of 1981 ).
