EUROPEAN COMMUNITIES (AGRICULTURAL OR FORESTRY TRACTORS TYPE APPROVAL) REGULATIONS, 1989. I, MICHAEL O'KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directives 87/402/EEC of 25 June, 1987

(1), and 89/173/EEC of 21 December, 1988
(2), in so far as those Directives apply to the type approval of agricultural or forestry tractors and components, hereby make the following Regulations:
(1)OJ No. L 220, 8.8.1987, p.1.

  2. These Regulations may be cited as the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1989, and shall come into operation on the 15th day of November,
  4. In these Regulations "the Regulations of 1979" means the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1979 ( S.I. No. 137 of 1979 ).
  5. The following Regulation is hereby substituted for Regulation 11 (inserted by the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1988 ( S.I. No. 162 of 1988 ) and amended by the European Communities (Agricultural or Forestry Tractors Type Approval) (No. 2) Regulations, 1988 ( S.I. No. 361 of 1988 )) of the Regulations of 1979: "
  6. The manufacturer of a tractor approved under Regulation 5 of these Regulations shall cause it to be fitted with a roll-over protection structure which satisfies the relevant provisions of the Directives referred to at reference numbers 11, 17, 21 or 23 of Schedule I to these Regulations.".
  7. Schedule I (inserted by the European Communities (Agricultural or Forestry Tractors Type Approval) (No. 2) Regulations, 1988 ( S.I. No. 361 of 1988 )) to the Regulations of 1979 is hereby amended by the insertion in columns

(5)in that Schedule after item No. 22 of the following matter: "
  1. 87/402/EEC 25 June l987 OJ No. L 220/1 of 8.8.87 Roll-over protection structures mounted in front of driver's seat on narrow- track wheeled agricultural or forestry tractors.
  2. 89/173/EEC 21 December 1988 OJ No. L 67/1 of 10.3.89 Certain components and characteristics." GIVEN under my Official Seal this 7th day of November,
