No. 71/1989 - Garda Síochána (Registration of Certain Births and Deaths Occurring Outside The State) Regulations, 1989 AmendmentsLeasuithe I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by section 4 of the Garda Sióchana Act, 1989 (No. 1 of 1989), and with the consent of the Minister for Health, hereby make the following Regulations: 1 Short title. 1. These Regulations may be cited as the Garda Síochána (Registration of Certain Births and Deaths Occurring Outside the State) Regulations, 1989. 2 Definitions. 2. In these Regulations— "member" means a member of the Garda Síochána; "member in charge" means the member in charge of a contingent of the Garda Síochána serving outside the State with an International United Nations Force; "the Principal Act" means the Garda Síochána Act, 1989 (No. 1 of 1989); 3 Record of death of member of Garda Síochána. 3.
(1)The member in charge shall keep a record of the death of a member occurring outside the State while the member is serving outside the State with an International United Nations Force.
(2)A record kept pursuant to this Regulation shall be in the form set out in the First Schedule to these Regulations and contain the particulars required by the form. 4 Record of death of spouse or other relative or dependant of a member of Garda Síochána. 4.
(1)The member in charge shall keep a record of the death of the spouse, or of a relative or dependant of a member, or of the spouse of a member, occurring outside the State, while the member is serving outside the State with an International United Nations Force and is accompanied by such spouse, or relative, or dependant.
(2)A record kept pursuant to this Regulation shall be in the form set out in the First Schedule to these Regulations and contain the particulars required by the form. 5 Record of birth of child of a member of Garda Síochána. 5.
(1)The member in charge shall keep a record of the birth of a child of a member occuring outside the State while the member is serving outside the State with an International United Nations Force and, if the member of a man, while the mother of the child is accompanying him.
(2)A record kept pursuant to this Regulation shall be in the form set out in the Second Schedule to these Regulations and contain the particulars required by the form.
(3)A record kept pursuant to this Regulation shall be signed, in column
(7)of the form in which it is kept opposite the signature of the member compiling the record, by the person who informed that member of the birth to which it relates and the date of such signing shall be inserted in the said column. 6 Transmission of record to Commissioner.
- A record kept under these Regulations by a member other than the Commissioner shall be transmitted by that member to the Commissioner as soon as may be after its compilaton. 7 Numbering of records by Commissioner
- A record kept pursuant to Regulation 3, 4 or 5 of these Regulations shall be given a number by the Commissioner and the number shall be inserted by the Commissioner in column
(1)of the form in which the record is kept opposite the particulars of the death or birth, as the case may be, to which the record relates. 8 Authentication of record by Commissioner and transmission to an tArd-Cháraitheroir. 8. A record kept under these Regulations shall be authenticated by the Commissioner by his signing his name, and inserting the date of such signing, in column
(10), or as the case may be,
(9)of the form in which the record is kept opposite the signature of the member who compiled the record and the record shall be transmitted by registered post or special dispatch to an tArd-Chláraitheoir by the Commissioner as soon as may be after such authentication. 9 Entry made by an tArd-Chláraitheoir to be copy of the record. 9. ( a ) An entry made in the Garda Sióchána Deaths Register Book by an tArd-Chláraitheoir, pursuant to subsection
(3)of section 4 of the Principal Act, of a record of a death transmitted to him under the said section 4 shall be a copy of the record. ( b ) An entry made in the Garda Sióchána Births Register Book by an tArd-Chláraitheoir, pursuant to the said subsection
(3), of a record of a birth transmitted to him under the said section 4 shall be a copy of the record. FIRST SCHEDULE Garda Síochána Act, 1989. Record of the death, occurring outside outside the State, of (
- a)A member, while the member is serving outside the State with an International United Nations Force, or (
- b)The spouse, or a relative or dependant of such a member, or of the spouse of such a member, while the member is so serving and is accompanied by such spouse or relative or dependant. - Record of the birth of a child of a member of the Garda Síochána occurring outside the State while the member is serving outside the State with an International United Nations Force and, if the member is a man, while the mother of the child is accompanying him.
