DISEASES OF ANIMALS (BOVINE SPONGIFORM ENCEPHALOPATHY) (AMENDMENT) (No. 3) ORDER, 1990. I, MICHAEL O' KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 3 and 13 of the Diseases of Animals Act, 1966 (No. 6 of 1966), as adapted by the Agriculture (Alteration of Name of Department and Title of Minister) Order, 1987 ( S.I. No. 97 of 1987 ), hereby order as follows: 1.
(1)This Order may be cited as the Diseases of Animals (Bovine Spongiform Encephalopathy) (Amendment) (No. 3) Order, 1990.
(2)The collective citation "the Diseases of Animals (Bovine Spongiform Encephalopathy) Orders, 1989 and 1990" shall include this Order.
(3)The Diseases of Animals (Bovine Spongiform Encephalopathy) Orders, 1989 and 1990, shall be construed together as one.
(4)This Order shall come into operation on the 13th day of August,
- In this Order "animal" means a bovine animal, sheep, goat, deer or any other ruminant animal; "animal protein" means any protein material which is derived from a carcase but does not include milk or any milk product or dicalcium bone phosphate; "carcase" means the carcase of an animal and includes part of a carcase, and the meat, bones, hide, blood, skin, pelt, hair, wool, hooves, horns, offal or other part of an animal, separately or otherwise, or any portion thereof. 3.
(1)Subject to paragraph
(2)of this Article, a person shall not— ( a ) sell or supply for feeding to an animal, or ( b ) feed to an animal, any feedingstuff in which animal protein has been incorporated knowing or having reason to suspect that animal protein has been incorporated therein.
(2)Paragraph
(1)of this Article shall not apply to the sale or supply of any feedingstuff for feeding, or the feeding of any feedingstuff, to an animal in a research establishment under the authority of the Minister for Agriculture and Food where such sale, supply or feeding (as the case may be) is in accordance with the conditions of a licence issued by him. This Order imposes a ban on the sale or supply for feeding to ruminant animals and the feeding to such animals of feedingstuff containing animal protein derived from ruminant animals, except where authorised research is being carried out.
