INTERNATIONAL CARRIAGE OF GOODS BY ROAD ACT, 1990 (CMR CONTRACTING PARTIES) ORDER, 1991. I, SÉAMUS BRENNAN, Minister for Tourism, Transport and Communications, in exercise of the powers conferred on me by section 2
(2)of the International Carriage of Goods by Road Act, 1990 (No. 13 of 1990), as adapted by the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1991 ( S.I. No. 25 of 1991 ), and after consultation with the Minister for Foreign Affairs, hereby order as follows:
- This Order may be cited as the International Carriage of Goods by Road Act, 1990 (CMR Contracting Parties) Order,
- It is hereby declared— ( a ) that the states specified in Part I of the Schedule to this Order are Contracting Parties to CMR (that is to say, the Convention on the Contract for the International Carriage of Goods by Road done at Geneva on the 19th day of May, 1956, as amended by the Protocol done at Geneva on the 5th day of July, 1978), and ( b ) that the declarations (the texts of which in the English language are set out Part II of the said Schedule) have been made by the United Kingdom pursuant to Article 46 of CMR to the Secretary-General of the United Nations. SCHEDULE PART I CONTRACTING PARTIES TO THE COVENTION ON THE CONTRACT FOR THE INTERNATIONAL CARRIAGE OF GOODS BY ROAD (CMR) AS AMENDED BY THE 1978 PROTOCOL THERETO Austria Luxembourg Belgium Netherlands Demark Norway Finland Portugal France Romania Germany, Federal Republic of Spain Greece Sweden Ireland Switzerland Italy United Kingdom PART II DECLARATIONS MADE BY THE UNITED KINGDOM PURSUANT TO ARTICLE 46 OF CMR Declaration dated the 28th day of October 1968 "On instructions from Her Majesty's Principal Secretary of State for Foreign and Commonwealth Affairs, I have the honour to notify you that the Convention on the Contract for the International Carriage of Goods by Road (CMR), opened for signature at Geneva on the 19th of May, 1956, shall, in accordance with the provisions of Article 46 of the Convention, extend to Gibraltar." (Complimentary close) (Signed) CARADON Declaration dated the 10th day of November 1969 "Acting on instructions from Her Majesty's Principal Secretary of State for Foreign and Commonwealth Affairs, I have the honour to declare that, in accordance with the provisions of paragraph 1 of Article 46 of the Convention on the Contract for the International Carriage of Goods by Road (CMR), opened for signature at Geneva on the 19th of May, 1956, the Convention shall extend to the Isle of Man." (Complimentary close) (Signed) CARADON Declaration dated the 2nd day of March 1972 "I am directed by Her Majesty's Principal Secretary of State for Foreign and Commonwealth Affairs to declare that, in accordance with the provisions of paragraph 1 of Article 46 of the Convention on the Contract for the International Carriage of Goods by Road (CMR), opened for signature at Geneva on the 19th of May, 1956, the Convention shall extend to the Bailiwick of Guernsey." - SÉAMUS BRENNAN Minister for Tourism, Transport and Communications. EXPLANATORY NOTE. This Order, made by the Minister for Tourism, Transport and Communications after consultation with the Minister for Foreign Affairs, specifies the 18 Contracting Parties (including the State) to CMR, that is the Convention on the Contract for the International Carriage of Goods by Road as amended by the 1978 Protocol thereto, and sets out the text of the declarations made by the United Kingdom that CMR extends also to certain territories for the international relations of which it is responsible. Those declarations were supplemented by specific declarations made by the United Kingdom under Article 7 of the Protocol that the Protocol extends also to those territories. There are 6 Contracting Parties to the Convention only, namely, Bulgaria, Czechoslovakia, Hungary, Poland, Union of Soviet Socialist Republics and Yugoslavia.
