HARBOUR RATES (WICKLOW HARBOUR) ORDER, 1991. I, JOHN P. WILSON, Tanaiste and Minister for the Marine, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), and after due compliance with Section 106 of the said Harbours Act, 1946 , hereby order as follows: 1.

(1)This Order may be cited as the Harbour Rates (Wicklow Harbour) Order, 1991.
(2)This Order shall come into operation on the 18th day of March,
  2. In this Order "the Order of 1988" means the Harbour Rates (Wicklow Harbour) Order, 1988 ( S.I. No. 157 of 1988 ). 3.
(1)The Harbour Rates (Wicklow Harbour) Order, 1949 ( S.I. No. 172 of 1949 ), is hereby amended by— ( a ) the substitution for the First Schedule (inserted by the Order of 1988) thereto of the following Schedule: "FIRST SCHEDULE Actual Goods Rates Commodity Unit of Quantity Rate Cement Per tonne 54p Coal and coke " " 30p Fertiliser " " 35p Grain " " 31p Oil " " 153p Paper " " 54p Phosphates " " 31p Pulp " " 27p Steel " " 54p Stone " " 21p Timber " " 54p Vehicles Each 196p Cattle and all other animals " 27p each Containers: 8’ x 8’ x 20’ 8’ x 8’ x 40’ Each " Laden: £3,51; £7.02 Empty: 54p £1.07 Goods not otherwise mentioned in this Schedule per tonne 54p " Ref. No. Description of Charge Rate (b) (i) On every decked or part decked pleasure boat of 1.5 tons gross or under, being neither a catamaran nor a trimaran, as a composition in full in lieu of tonnage rates payable half-yearly in advance, for the period—
(1)15th April-14th October, a sum of £32.34
(2)15th October-14th April, a sum of £32.34 (ii) On every catamaran or trimaran of 1.5 tons gross or under as a composition in full in lieu of tonnage rates payable half-yearly in advance, for the period—
(1)15th April-14th October, a sum of £48.56
(2)15th October-14th April, a sum of £48.56 (c) On every decked or part decked pleasure boat of 10 tons gross or under but over 1.5 tons gross as a composition in full in lieu of tonnage rates payable half-yearly in advance, for the period—
(1)15th April-14th October, a sum of £64.68
(2)15th October-14th April, a sum of £64.68 (d) On every decked or part decked pleasure boat over 10 tons gross as a composition in full in lieu of tonnage rates payable half-yearly in advance, for the period—

  1. e)On all pleasure boats entering the Harbour and not paying the composition rates at reference number 3 (a), (b), (
  2. c)or (
  3. d)above and remaining in the harbour overnight: £3.20 For vessels remaining in the harbour less than 7 days: £5.80 (
  4. b)the substitution for the Second Schedule (inserted by the Order of 1988) thereto of the following Schedule: "SECOND SCHEDULE. Actual Tonnage Rates Ref. No. Description of Charge Rate 1. Tonnage rates on vessels other than those described at reference numbers 2 and 3 below: (
  5. a)On every ton of the net register tonnage or half the gross tonnage, whichever is the greater, of every vessel entering the harbour: 45p (
  6. b)On every ton of the net register tonnage or half the gross tonnage, whichever is the greater of every vessel entering the harbour windbound: 23p 2. Rates on fishing vessels: (
  7. a)As a composition in full in lieu of tonnage rates on every fishing vessel entering the harbour for the purpose of landing fish, per year: £44.00 (
  8. b)On every fishing vessel entering the harbour for any purpose other than landing fish, for each entry: £5.80 (
  9. c)On every fishing vessel entering the harbour windbound, per entry: £3.00 The rates at 2 (
  10. b)and (
  11. c)are chargeable for each stay in the harbour of seven days or part thereof. 3. Rates on Pleasure Boats: (
  12. a)(
  13. i)On every open pleasure boat of 1 ton gross or under, not being a pleasure boat described in Clause (
  14. ii)of this subparagraph, as a composition in full in lieu of tonnage rates payable yearly in advance, a sum of: £5.80 (
  15. ii)On every open pleasure boat of 1 ton gross or under with cuddy or cabin not exceeding six feet in length as a composition in full in lieu of tonnage rates payable yearly in advance, a sum of: £16.20 For vessels remaining in the harbour between 7 and 14 days a further: £9.80 For vessels remaining in the harbour between 14 and 21 days a further: £17.40 And for every 7 days or part thereof over 21 days a further: £17.40 and ( c ) the substitution for the Third Schedule (inserted by the Order of 1988) thereto of the following Schedule: "THIRD SCHEDULE Other Actual Charges Ref. No. Description of Charge Rate Provided that reasonable use and enjoyment of any quay is not interfered with or obstructed, goods authorised to be placed on the quays whether for import or export, may remain on the quay, free of charge, for a period of seven days exclusive of Saturdays, Sundays and Public Holidays, hereinafter referred to as "the Permitted Period"; 1.
(1)For every square metre occupied by the goods after the expiration of the permitted period; (
  1. i)For the first seven days 7p per sq. metre per day. (
  2. ii)after the first seven days after the expiration of the permitted period 40p per sq. metre per day. 2. Ballast, per tonne— 27p 3. For the use of any wharf, pier or quay for the launching, lifting out, repairing, fitting or servicing of vessels, per period of seven days or part thereof: £7.60
(2)Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows: ( a ) any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes, ( b ) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes, ( c ) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall count as 750 Kilogrammes, ( d ) any weight exceeding 750 kilogrammes but not exceeding 1 tonne shall count as 1 tonne.
  1. The Harbour Rates (Wicklow Harbour) Order, 1988 ( S.I. No. 157 of 1988 ), is hereby revoked. GIVEN under my Official Seal, this 5th day of March,
