GREAT NORTHERN RAILWAY COMPANY (IRELAND) PENSION FUND FOR WAGES STAFF (AMENDMENT) SCHEME (CONFIRMATION) ORDER, 1992. I, MÁIRE GEOGHEGAN-QUINN, Minister for Tourism, Transport and Communications, in exercise of the powers conferred on me by section 44 of the Transport Act, 1950 (No. 12 of 1950), as applied by section 15 of the Great Northern Railway Act, 1958 (No. 20 of 1958), and amended by the Communications (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1987 ( S.I. No. 92 of 1987 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1991 ( S.I. No. 25 of 1991 ), hereby, after consultation with the Minister for Finance, order as follows: 1. This Order may be cited as the Great Northern Railway Company (Ireland) Pension Fund for Wages Staff (Amendment) Scheme (Confirmation) Order, 1992. 2. In this Order, "the amending Scheme" means the Scheme amending the Great Northern Railway Company (Ireland) Pension Fund for Wages Staff prepared by the Board and submitted to the Minister for Tourism, Transport and Communications under section 15 of the Great Northern Railway Act, 1958 (No. 20 of 1958), and set out in the Schedule to this Order. 3. The amending Scheme is hereby confirmed and shall be deemed to have come into operation on the 1st day of February, 1991. SCHEDULE. GREAT NORTHERN RAILWAY COMPANY (IRELAND) PENSION FUND FOR WAGES STAFF (AMENDMENT) SCHEME, 1992. Definitions. 1. In this amending Scheme the following words and expressions shall have the meanings hereby assigned to them unless there is something in the subject matter or context repugnant to such construction:— "the existing Scheme" means the Great Northern Railway Company (Ireland) Pension Fund for Wages Staff as amended by the amending Schemes confirmed by Statutory Instruments numbered 53 of 1962, 50 of 1965, 9 of 1967, 60 of 1969, 81 of 1971, 251 of 1974, 291 of 1977, 76 of 1980, 183 of 1982, 290 of 1985, 321 of 1985, 54 of 1987, 195 of 1988, 260 of 1988, 30 of 1989 and 232 of 1991. "the operative date" means the 1st day of February, 1991. "this Scheme" means the existing Scheme as hereby amended. In this amending Scheme unless otherwise expressly stated words and expressions used shall have the meanings assigned to them by the existing Scheme. Continuance of the existing Scheme. 2.
(1)The benefits provided by the existing Scheme shall continue to be paid or be payable under and in accordance with the terms thereof and without alteration to every pensioner whose right to pension accrued prior to the operative date or to the personal representative of such a p0ensioner and to the personal representative of a member whose death occurred prior to the operative date.
(2)Nothing in this amending Scheme shall affect the rights of any of the persons mentioned in the previous sub-article, nor shall this amending Scheme affect any subsisting right or liability accrued to or incurred by any person under the existing Scheme prior to the operative date.
(3)Deferred and special pensions now payable or at any time to become payable shall not be affected by this amending Scheme. Amendment of the existing Scheme. 3.
(1)Subject to the provisions of Article 2 of this amending Scheme, the existing Scheme shall be amended with effect on and from the operative date so as to conform to the provisions hereinafter contained and every provision of the existing Scheme which is inconsistent with the provisions hereinafter contained shall cease to have effect.
(2)The increased contributions and benefits provided for by this amending Scheme are, where applicable, in substitution for the corresponding contributions and benefits provided for by the existing Scheme. Rate of Contribution. 4. The Table of Rates of Contributions inserted in the existing Scheme by Article 5 of the Schedule to Statutory Instrument No. 260 of 1988 shall be deleted and as from the operative date all members shall contribute to this Scheme by payment into the Fund at the rates determined by reference to columns

(6)of Tables A and B in Article 5 of this amending Scheme. Full Pension. 5. Table A of the existing Scheme shall be deleted and, in respect of any pension the right to which accrues on or after the operative date, the full pensions (including alternative full pensions and the total payments) for all members except Particular Female Members shall be the amounts determined by reference to columns
