I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive 92/19/EEC

(1)of 23 March 1992, hereby make the following Regulations:

(1)These Regulations may be cited as the European Communities (Seed of Fodder Plants) (Amendment) (No. 3) Regulations, 1992 and shall come into operation on the 4th day of December 1992.
(2)The European Communities (Seed of Fodder Plants) Regulations, 1981 to 1991, and these Regulations may be cited together as the European Communities (Seed of Fodder Plants) Regulations, 1981 to 1992 and shall be construed together as one. 2.
(1)In these Regulations— "the Principal Regulations" means the European Communities (Seed of Fodder Plants) Regulations, 1981 ( S.I. No. 112 of 1981 ); "the Regulations of 1988" means the European Communities (Seed of Fodder Plants) (Amendment) Regulations, 1988 ( S.I. No. 161 of 1988 ); "the Regulations of 1991" means the European Communities (Seed of Fodder Plants) (Amendment) Regulations, 1991 ( S.I. No. 110 of 1991 ). 3. Regulation 2
(1)of the Principal Regulations (as amended by the Regulations of 1988) is hereby amended by the insertion, in the definition of "fodder plants", of the following: "Festuca pratensis Huds x Lolium multiflorum Lam. Hybrid resulting from the crossing of tall fescue with Italian ryegrass (including Westerworld ryegrass) (x Festulolium)." 4. Regulation 2
(2)of the Principal Regulations (as amended by the Regulations of 1991) is hereby amended by the insertion after "30 June, 1989" of "and Commission Directive 92/19/EEC of 23 March 1992.".
  1. Regulation 5 of the Principal Regulations (as amended by the Regulations of 1991) is hereby amended by the insertion in the table of "x Festulolium" after "Festuca rubra L".
  2. The Schedule to the Principal Regulations is hereby amended— ( a ) in Annex 1.3— (i) by the insertion in the second sentence, after "Lolium Species", in each place where it appears, of "x Festulolium"; ( b ) in Annex II

These Regulations amend existing Regulations to include hybrids resulting from the crossing of the species Festuca pratensis Huds, with Lolium multiflorum Lam. Annexes I, II and III of the schedule to the Principal Regulations have also been amended to adopt the conditions to be satisfied by the seed and lot sample weights of Festulolium species.
