LOCAL GOVERNMENT ACT, 1991 (RESERVED FUNCTIONS) ORDER, 1993. The Minister for the Environment in exercise of the powers conferred on him by section 41

(2)of the Local Government Act, 1991 (No. 11 of 1991) hereby orders as follows:—
  1. This Order may be cited as the Local Government Act, 1991 (Reserved Functions) Order,
  3. It is hereby declared that each function of a local authority specified in the Schedule to this Order shall be performed, insofar as the same is performable by such authority, by resolution of the members of that authority.
  4. This Order shall come into operation on the 1st day of March,
  5. SCHEDULE The making of a contribution under section 40 of the Local Government (Sanitary Services) Act, 1948 . The making of arrangements under section 96
(1)of the Road Traffic Act, 1961 . The making of a request to the Minister to extend the period during which a planning authority may comply with the requirements of section 20
(1)of the Local Government (Planning and Development) Act, 1963 . Entry into an agreement under section 7 of the Local Authorities (Traffic Wardens) Act, 1975 . The making of a contribution under section 29 of the Local Government (Water Pollution) Act, 1977 . The making of a plan under article 4 of The European Communities (Waste) Regulations, 1979. The making of a scheme under section 279
(5)of the Social Welfare (Consolidation) Act, 1981 . The making of a special waste plan or of any variation in such plan under article 4 of the European Communities (Toxic and Dangerous Waste) Regulations, 1982. Entry into arrangements under section 15
(2)or 15
(3)of the Control of Dogs Act, 1986 and the granting of assistance (other than the provision of services of staff) under section 15
(4)of that Act. The making of a decision to provide a public abattoir under section 19
(1)of the Abattoirs Act, 1988 . The consideration of a request made under section 30
(3)of the Local Government Act, 1991 . GIVEN under the Official Seal of the Minister for the Environment, this 10th day of February, 1993. MICHAEL SMITH, Minister for the Environment. EXPLANATORY NOTE. This Order declares that various local authority functions, listed in the Schedule, shall be performed by resolution of the elected members of the authority and these functions thus become reserved functions for the purposes of the City and County Management Acts.
