FUELS (PETROLEUM OILS) (AMENDMENT) ORDER, 1994. I, BRIAN COWEN, T. D., Minister for Transport, Energy and Communications, in exercise of the powers conferred on me by section 3

(5)of the Fuels (Control of Supplies) Act, 1971 (No. 3 of 1971), the Energy (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1993 ( S.I. No. 12 of 1993 ), the Tourism, Transport and Communications (Alteration of Name of Department and Title of Minister) Order, 1993 ( S.I. No. 17 of 1993 ), and the Tourism and Trade (Transfer of Departmental Administration and Ministerial Functions) Order, 1993 ( S.I. No. 422 of 1993 ), hereby order as follows:
  1. This Order may be cited as the Fuels (Petroleum Oils) (Amendment) Order,
  2. This Order shall come into operation on the 1st day of July,
  3. In this Order "the Principal Order" means the Fuels (Petroleum Oils) Order, 1983 ( S.I. No. 2 of 1983 ).
  4. Article 3 of the Principal Order is hereby amended by the substitution of "gasoline" for "premium gasoline" in paragraph (f) and the deletion of paragraph (g).
  5. Article 5 of the Principal Order is hereby amended by the substitution of the following Article for Article 5: "
  6. Notwithstanding Article 4 of this Order, a person to whom this Order applies shall be taken to have complied with that Article if he purchases from the Corporation the quantity of a type of petroleum oil required by that Article to be purchased by him, less 5 tonnes (in respect of any quarter) of that type of petroleum oil.".   7. BRIAN COWEN, Minister for Transport, Energy and Communications. EXPLANATORY NOTE. This Order applies to persons who import into the State certain petroleum products either for their own use or for disposal in the State. Such persons are legally obliged to purchase a certain proportion of such petroleum products from the Irish National Petroleum Corporation Limited. Persons for whom the relevant proportion is calculated to be less than 20 tonnes have, effectively, been exempt from this obligation. This Order reduces the threshold under which this exemption applies from 20 tonnes to 5 tonnes. The Order also amends the product range to which the purchase obligation applies.
