EUROPEAN COMMUNITIES (AWARD OF PUBLIC SUPPLY CONTRACTS) (AMENDMENT) REGULATIONS, 1994. WHEREAS Council Directive No. 93/36/EEC of 14 June 19931, consolidates with amendments the provisions of Council Directive No. 77/62/EEC of 21 December 19762 as amended; 1O.J. No L 199 of 9 August 1993, p.1. 2O.J. No L 13 of 15 January 1977, p.1. Now I, BERTIE AHERN, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 93/36/EEC of 14 June 19931 hereby make the following Regulations: 1O.J. No L 199 of 9 August 1993, p.1. 1. These Regulations may be cited as the European Communities (Award of Public Supply Contracts) (Amendment) Regulations, 1994. 2.
(1)In these Regulations "the Council Directive" means Council Directive No. 93/36/EEC of 14 June 19931.
(2)A word or expression that is used in these Regulations and is also used in the Council Directive has, unless the contrary intention appears the same meaning in these Regulations as it has in the Council Directive.
- Any reference in the European Communities (Award of Public Supply Contracts) Regulations, 1992 ( S.I. No. 37 of 1992 ), or in any other enactment to Council Directive No. 77/62/EEC of 21 December 19761, or to any provision thereof shall be construed as a reference to the Council Directive or to the corresponding provision thereof in accordance with the correlation table set out in Annex VI to the Council Directive. In general, the procedures must be followed when contract value exceeds the relevant thresholds in the Directive.
