TELECOMMUNICATIONS (AMENDMENT) SCHEME, 1995. BORD TELECOM ÉIREANN in exercise of the powers conferred on it by Section 90 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983) hereby makes the following Scheme: 1. This Scheme may be cited as the Telecommunications (Amendment) Scheme, 1995. 2.

(1)The collective citation "the Telecommunications Schemes, 1994 and 1995" includes this scheme.
(2)This Scheme shall be deemed to have come into operation on 1 January,
  1. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.
  2. The Telecommunications Scheme, 1994 ( S.I. No. 177 of 1994 ) and the Telecommunications (Amendment) (No. 2) Scheme, 1994 ( S.I. No. 272 of 1994 ) are hereby amended by: ( a ) the substitution of the following Article for Article 18
(2): "18
(2)For the purpose of this Scheme, "Eligible International Volume Discount Calls" shall mean subscriber dialled calls made to telephones outside the State (excluding Northern Ireland) made from a telephone exchange line rented by the subscriber but excluding subscriber dialled calls made by use of the Switched Digital International facility and also excluding Chargecard calls, Eircell calls and Eirpac calls. "; ( b ) the insertion of the following Article 20A after Article 20: "20A
(1)Bord Telecom Éireann may, where the amount otherwise due (exclusive of Value Added Tax) on a quarterly account in respect of Eirpac calls exceeds the appropriate amount specified in the Fourth Schedule to this Scheme, apply thereto a discount (hereinafter "Eirpac Volume Discount") in respect of such amounts. The Eirpac Volume Discount shall be calculated as set out in the Fourth Schedule to this Scheme. Bord Telecom Éireann may at its absolute discretion withdraw the Eirpac Volume Discount from all or any subscribers.
(2)It shall be a condition of the application of the Eirpac Volume Discount that: (
  1. i)The Eirpac calls shall be made by the subscriber or by employees of the subscriber; and (
  2. ii)accounts to which the Eirpac Volume Discount applies must be discharged in full with 14 days or by means of direct debit mandate approved by Bord Telecom Éireann. "; ( c ) the substitution of the following Article for Article 103: "103.
(1)An Eirpac subscriber shall pay to Bord Telecom Éireann in respect of any Eirpac call or attempted Eirpac call originating from or on equipment or apparatus under his control Eirpac call charges calculated with reference to the total charges applicable to: ( a ) the volume of data passed through and measured in units (each capable of containing sixty four characters of data including non-alphanumeric characters and spaces, and known as segments) determined and recorded by the packet switching exchange and not by reference to the volume of data originated and received by the subscriber's equipment and apparatus; and ( b ) the duration (where applicable) of the Eirpac call determined and recorded by the packet switching exchange.
(2)The charges applicable to the volume and duration and where appropriate dial up access referred to at (a) and (b) respectively of paragraph
(1)above are set forth in the Fourth Schedule to this Scheme. Such charges shall be calculated at the appropriate rate by reference to the charging bands set out in in the said Schedule to this Scheme.
(3)Every Eirpac call made by dial up access to the public switched telephone exchange system, shall in addition to the charges referred to at (a) and (b) of paragraph
(1)be considered to be a local call and the appropriate local call charge specified in Part 2 of the First Schedule will be applied thereto.
(4)An Eirpac subscriber shall pay in advance to Bord Telecom Éireann in respect of subscription for Eirpac service the appropriate sums set forth in the Fourth Schedule to this Scheme.
(5)An Eirpac subscriber shall pay to Bord Telecom Éireann in respect of connection charges the sums set forth in the Fourth Schedule to this Scheme.
(6)An Eirpac subscriber shall pay to Bord Telecom Éireann in respect of the facilities listed in the Fourth Schedule to this Scheme the sums set forth in the said Schedule. The charge for a call to a Pactex Mailbox rented by an Eirpac subscriber shall be the sum of 22.2p per each three minute period or part thereof. 2. The charge for a call to an Eirpac subscriber (other than a call to a Pacetex Mailbox) shall be calculated as follows:— (a) Telex Access For each 3 minute period or part thereof 22.2p (b) Pactex Access For each 1 minute period or part thereof 6.6p (c) Eirpac Volume Charge 1p per kilobyte TELEX BOOTH CHARGE. The Telex Booth Charge is a charge of £1 per call in addition to the Call Charges. CHARGES FOR PACTEX The charge for a call to an Eirpac subscriber via Pactex shall be the sum of 22.2p. per each period or part of a period specified in the Table below: TABLE.
