S.I. No. 113/1996 - Harbour Rates (Limerick Harbour) Order, 1996.

(1)This Order may be cited as the Harbour Rates (Limerick Harbour) Order, 1996.

(2)This Order shall come into operation on the 6th day of May,

2. In this Order "the Order of 1992" means the Harbour Rates (Limerick Harbour) Order, 1992 ( S.I. No. 229 of 1992 ).
3. The Harbour Rates (Limerick Harbour) Order, 1942 (S.R. & O., No. 469 of 1942), is hereby amended by: ( a ) the substitution for paragraph

(3)of Article 5 of the following paragraph: "

(3)where rates payable under this Article are fixed at a tonnage charge, lesser weights shall be chargeable as follows: ( a ) any weight under 500 kilos shall count as 500 kilos; ( b ) any weight over 500 kilos and under a tonne shall count as a tonne." For every tonne of the admeasurement of every vessel arriving in the Port of Limerick or the Shannon Estuary discharging or loading cargo, for every arrival a sum not exceeding 0.72 2. For every tonne of the admeasurement of every vessel arriving in the Port of Limerick or the Shannon Estuary for a purpose other than to load or discharge cargo, for every arrival a sum not exceeding 0.35 3. For every tonne of the admeasurement of every vessel lying in the Port of Limerick or any part of the Shannon Estuary (other than any part of that river included within the harbours of Foynes, Kildysart, Glin, Tarbert or Kilrush), more than one month, for every period of seven days exceeding the first month of any part of such period, a sum not exceeding 0.27 4. For every tonne of the admeasurement of every Passenger vessel arriving in the Port of Limerick or the Shannon Estuary, for every arrival, a sum not exceeding. 0.10 5. For every vessel trading on the River Shannon, for every cargo carried ( a ) if not exceeding 150 tonnes Net Register Tonnage a sum not exceeding 6.16 ( b ) if exceeding 150 tonnes Net Registered Tonnage, for every tonne of the Net Registered Tonnage above 150 tonnes a sum not exceeding 0.27 " ( c ) the substitution for the Second Schedule (inserted by the Order of 1992) thereto of the following Schedule: "SECOND SCHEDULE Maximum Tonnage Rates chargeable in all vessels entering or using the Port of Limerick or the Shannon Estuary. For every tonne of the admeasurement of every vessel arriving in the Port of Limerick or the Shannon Estuary and discharging or loading, for every arrival a sum not exceeding 0.45 2. For every tonne of the admeasurement of every vessel arriving in the Port of Limerick or the Shannon Estuary for a purpose other than to load or discharge cargo, for every arrival, a sum not exceeding 0.23 3. For every tonne of the admeasurement of every vessel lying in the Port of Limerick or any part of the Shannon Estuary (other than any part of that river included within the respective areas of the harbours of Foynes, Kildysart, Glin, Tarbert or Kilrush), more than one month, for every period of seven days exceeding the first month of any part of such period, a sum not exceeding 0.19 4. For every tonne of the admeasurement of every Passenger vessel arriving in the Port of Limerick or the Shannon Estuary, for every arrival, a sum not exceeding 0.06 5. For every tonne of the admeasurement of every vessel trading upon the River Shannon, for every cargo carried a sum not exceeding 0.11 PART II Provisions applicable to rates mentioned in Part I (
5. a)of this Schedule. 1. The tonnage rates (other than those specified at reference number 5) shall not be chargeable on vessels trading in or upon the River Shannon. 2. For the purpose of calculating tonnage rates, the tonnage of vessels shall be taken to be the Gross Tonnage (GT) as laid down in the International Tonnage Convention. 1969. Provisions applicable to rates mentioned in Part I (
6. b)of this Schedule. 1. The tonnage rates (other than those specified at reference number 5) shall not be chargeable on vessels trading in or upon the River Shannon. 2. For the purpose of calculating tonnage rates, (other than those specified in reference number 5), the tonnage of vessels shall be taken to be the Net Registered Tonnage or half the Gross Registered Tonnage thereof whichever is the greatest."
