EUROPEAN COMMUNITIES (COSMETIC PRODUCTS) (AMENDMENT) REGULATIONS, 1996 The Minister for Health in exercise of the powers conferred on him by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby makes the following Regulations:— 1. These Regulations may be cited as the European Communities (Cosmetic Products) (Amendment) Regulations, 1996. 2. These Regulations may be construed as one with the European Communities (Cosmetic Products) Regulations, 1990 to 1994 and may be cited with those Regulations as the European Communities (Cosmetic Products) Regulations, 1990 to 1996. 3. In these Regulations "the Principal Regulations" means the European Communities (Cosmetic Products) Regulations, 1990 ( S.I. No. 265 of 1990 ). 5. Article 4
(1)of the Principal Regulations is hereby amended by the addition thereto in the definition of "the Principal Directive" of the references "94/32/EC30" and "95/34/EC31" 6. The provisions of Article 7
(1)of the Principal Regulations shall not apply until the 1st day of July, 1996, as respects the requirements of Commission Directive 95/34/EC, insofar as that Directive relates to the substances referred to in the Annex thereto. 7. The provisions of Article 7
(5)of the Principal Regulations shall not apply— (
- i)until 1st July, 1996, as respects the requirements of Commission Directive 94/32/EC insofar as that Directive relates to the substances referred to in Article 1 thereof, and (
- ii)until the 1st day of July, 1997, as respects the requirements of Commission Directive 95/34/EC, insofar as that Directive relates to the substances referred to in the Annex thereof. 8. Article 12 of the Principal Regulations is hereby amended by the insertion immediately after the reference "93/73/EEC" of the reference "95/32/EC32". EXPLANATORY NOTE The purpose of these Regulations is to update the principal regulations by giving effect to the Seventeenth and Eighteenth Commission Directives on cosmetics (94/3 2/EC and 95/34/EC). The effect of these Regulations is to further safeguard public health in regard to the substances which may be contained in cosmetic products having regard to the progress of scientific knowledge in cosmetology. The use of certain additional substances is permitted while the use of certain other substances is either prohibited or permitted subject to certain restrictions and conditions. The Regulations also give effect to the Sixth Commission Directive relating to the methods of analysis necessary for the official checking of the composition of cosmetic products (95/32/EC).
