ORDER ENTITLED STATISTICS (BALANCE OF PAYMENTS) ORDER, 1996. I, Jim Higgins, Minister of State at the Department of the Taoiseach, in exercise of the powers conferred on me by section 25
(1)of the Statistics Act, 1993 (No. 21 of 1993), and the Statistics (Delegation of Ministerial Functions) (No. 2) Order, 1995 ( S.I. No. 220 of 1995 ), hereby order as follows : 1.
(1)This Order may be cited as the Statistics (Balance of Payments) Order, 1996.
(2)This Order shall come into operation on the 3rd day of December, 1996. 2. In this Order "the Act of 1993" means the Statistics Act, 1993 (No. 21 of 1993); "non-resident" means a person who is not a resident; "resident" means - ( a ) any person residing in the State, ( b ) any person conducting a business within or outside the State who has in the State a registered office in respect of that business, or ( c ) in respect of a business conducted at a location in the State, the person conducting that business. 3. This Order applies to - ( a ) all persons and undertakings engaged in, ( b ) all persons and undertakings acting on behalf of other persons and undertakings engaged in, or ( c ) associations of persons and undertakings referred to in paragraphs (
- a)and (
- b)which collect information from those persons and undertakings relating to, all or any of the transactions specified in Part I of the Schedule to this Order. 4. For the purposes of section 25 of the Act of 1993 - ( a ) the general nature of the information required under this Order to be provided is statistical information in respect of all or any of the transactions specified in Part I of the Schedule to this Order and statistical information of the type specified in Part II of that Schedule, ( b ) the information shall be provided for the year 1996 and for subsequent monthly, quarterly, half yearly and annual periods in accordance with instructions prepared by the Director General pursuant to section 23 of that Act, and ( c ) the persons and undertakings required to provide the information specified in paragraph (
- a)are - (
- i)all persons and undertakings engaged in, (
- ii)all persons and undertakings acting on behalf of other persons and undertakings engaged in, or (iii) associations of persons and undertakings referred to in subparagraphs (
- i)and (
- ii)which collect information from those persons and undertakings relating to, all or any of the transactions specified in Part I of the Schedule to this Order. SCHEDULE Part I ( a ) Provision of goods, services or financial instruments to a non-resident; ( b ) Receipt of goods, services or financial instruments from a non-resident; ( c ) Acquisition or disposal of a financial claim on a non-resident; ( d ) Incurrence or redemption of a financial liability to a non-resident. Part II ( a ) Particulars of shareholdings in or ownership of the undertaking; ( b ) Particulars of shareholdings in or ownership of any other undertaking; ( c ) The value of goods, services and financial instruments provided by a person or an undertaking to non-residents in the period concerned; ( d ) The value of goods, services and financial instruments received by a person or an undertaking from non-residents in the period concerned; ( e ) The value of transactions in respect of financial claims on non-residents engaged in by a person or an undertaking ; ( f ) The value of transactions in respect of financial liabilities to non-residents engaged in by a person or an undertaking; ( g ) The value of financial claims on non-residents held by a person or an undertaking ( h ) The value of financial liabilities to non-residents held by a person or an undertaking; ( i ) The trading name or names and any other aliases by which the undertaking is known; ( j ) The description of the business in which the person or undertaking is engaged.
