ORDER entitled WIRELESS TELEGRAPHY ACT, 1926 (SECTION 3) (EXEMPTION OF CORDLESS TELEPHONES) ORDER, 1997 I, Etain Doyle, Director of Telecommunications Regulation, in exercise of the powers conferred on me by subsection
(6)(inserted by section 11 of the Wireless Telegraphy Act, 1972 (No. 5 of 1972)) of section 3 of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), and section 4 of the Telecommunications (Miscellaneous Provisions) Act, 1996 (No. 34 of 1996), hereby order as follows:
- This Order may be cited as the Wireless Telegraphy Act, 1926 (Section 3) (Exemption of Cordless Telephones) Order,
- The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.
- In this Order - "analogue cordless telephone" means apparatus for wireless telegraphy consisting of - ( a ) a fixed part that operates in the frequency band 31.02531.325 MHz, and ( b ) one or more portable parts that operate in the frequency band 39.92540.225 MHz, between which radio communication can be effected using equipment in conformity with Section 3.2 of the specification known as Telecommunications Terminal Equipment 9; or TTE
- "CT2-CAI" means digital cordless radio communications equipment that operates in the radio frequency band 864.1868.1 MHz and complies with Interim European Telecommunications Standard 300 131, and any amendments of that standard, issued by the European Telecommunications Standards Institute; "DECT" means the pan-European digital cordless radio communications equipment that operates in the frequency band 18801900 MHz as designated by the European Communities (Digital European Cordless Telecommunication - DECT) Regulations, 1994 ( S.I. No. 168 of 1994 ), and stands approved under the European Communities (Telecommunications Terminal Equipment) Regulations, 1997 ( S.I. No. 73 of 1997 ); "digital cordless telephone" means apparatus for wireless telegraphy of the DECT or CT2—CAI type consisting of - ( a ) a fixed part, and ( b ) one or more portable parts, between which radio communication can be effected.
- Each of the following classes of apparatus for wireless telegraphy is hereby declared to be a class of apparatus for wireless telegraphy to which section 3 of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), is not to apply, namely: ( a ) digital cordless telephones, and ( b ) analogue cordless telephones.
