(5)) Regulations, 1997 AmendmentsLeasuithe WHEREAS a licence (entitled the Eircell (GSM and TAGS Services and Systems) Licence, 1996) was granted under subsection
(2)of Section 111 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), to Eircell Limited authorising it to provide a mobile telephony service and the licence is in force; AND WHEREAS a licence (entitled the Postal and Telecommunications (GSM Mobile Telephony) Licence, 1997) was granted to Esat Digifone Limited under the said subsection
(2)authorising it to provide a mobile telephony service and the licence is in force, NOW I, Mary O'Rourke, Minister for Public Enterprise, in exercise of the powers conferred on me by subsection
(5)of that section and the Transport, Energy and Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1997 ( S.I. No. 299 of 1997 ), hereby make the following Regulations: 1. These Regulations may be cited as the Postal and Telecommunications Services Act, 1983 (Section 111
(5)) Regulations,
- Sections 98 , as amended, and 110 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), are hereby specified for the purposes of the application, pursuant to section 111
(5)of that Act, of those sections to— ( a ) Eircell Limited, in respect of the provision by it of a mobile telephony service in accordance with the licence (entitled the Eircell (GSM and TACS Services and Systems) Licence, 1996) granted to it under section 111
(2)of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), and ( b ) Esat Digifone Limited, in respect of the provision by it of a mobile telephony service in accordance with the licence (entitled the Postal and Telecommunications (GSM Mobile Telephony) Licence, 1997) granted to it under the said section 111

Minister for Public Enterprise EXPLANATORY NOTE These Regulations provide for the application of sections 98 , as amended, and 110 of the Postal and Telecommunications Services Act, 1983 to Eircell Limited and to Esat Digifone Limited.
