No. 71 of 1997. ENERGY (MISCELLANEOUS PROVISIONS) ACT, 1995 (SECTION 14) ORDER, 1997. I, EMMET M. STAGG, T.D., Minister of State at the Department of Transport, Energy and Communications, in exercise of the powers conferred on me by section 14 of the Energy (Miscellaneous Provisions) Act, 1995 (No. 35 of 1995), and the Transport, Energy and Communications (Delegation of Ministerial Functions) Order, 1996 ( S.I. No. 395 of 1996 ), hereby make the following Order. 1. This Order may be cited as the Energy (Miscellaneous Provisions) Act, 1995 (Section 14) Order, 1997. 2. In this Order "the Board" means Bord Gáis Éireann. 3. The real and personal property, rights and liabilities of the Dublin Gas Company specified in an agreement made on the 3rd day of November, 1987, between that company of the first part, Bernard Somers, the receiver of the property of that company of the second part and the Board of the third part, other than the properties vested in the Board by the Energy (Miscellaneous Provisions) Act, 1995 (Section 14) Order, 1996 ( S.I. No. 274 of 1996 ) and the Energy (Miscellaneous Provisions) Act, 1995 (Section 14) (No. 2) Order, 1996 ( S.I. No. 329 of 1996 ), shall vest in the Board on the 4th day of February, 1997. 4. All the real and personal property, rights and liabilities of— ( a ) Limerick Gas Company Limited, ( b ) Cork Gas Company, ( c ) City of Waterford Gas Company, and ( d ) Clonmel Gas Company Limited, shall vest in the Board on the 4th day of February, 1997. GIVEN under my hand, this 4th day of February, 1997. EMMET M. STAGG, T.D. Minister of State at the Department of Transport, Energy and Communications. EXPLANATORY NOTE. This Order provides that the assets of Dublin Gas Company specified in an agreement made on 3 November, 1987, (within the exception of the properties already vested in the Board by previous Orders made under Section 14, namely S.I. No. 274 of 1996 and S.I. No. 329 of 1996 ), together with the assets of Limerick Gas Company Limited, Cork Gas Company, City of Waterford Gas Company and Clonmel Gas Company Limited be vested in Bord Gáis Éireann.
