HARBOURS ACT, 1996 (COMMENCEMENT) ORDER, 1997 I, SEÁN BARRETT, Minister for the Marine, in exercise of the powers conferred on me by section 1
(2)of the Harbours Act, 1996 (No. 11 of 1996), hereby order as follows:
- This Order may be cited as the Harbours Act, 1996 (Commencement) Order,
- The 3rd day of March, 1997, is hereby fixed as the day on which the following provisions of the Harbours Act, 1996 (No. 11 of 1996), shall come into operation in relation to the companies specified in the Schedule to this Order, namely— ( a ) Part I (other than section 5
(2)in so far as it relates to the Pilotage Act, 1913, and the Pilotage (Amendment) Act, 1962 ), ( b ) Parts II and III, ( c ) Part V (other than section 83
(2), section 84, in so far as it relates to section 71, sections 86 to 89, 91, 93 and 95), and ( d ) Part VI (other than section 105).
- The 3rd day of March, 1997, is hereby fixed as the day on which— ( a ) sections 92 , 93 and 95 of the Harbours Act, 1996 , shall come into operation in relation to each harbour authority, and ( b ) sections 89 and 91 of the said Act shall come into operation in relation to each local authority. - SEÁN BARRETT, Minister for the Marine. EXPLANATORY NOTE. This Order fixes the 3rd day of March, 1997 as the day on which Parts II, and III and certain provisions of Parts, I, V and VI of the Harbours Act, 1996 come into operation in relation to certain specified port companies. The order also fixes the 3rd day of March, 1997 as the day on which certain provisions of Part VI of the Act come into operation in relation to harbour authorities and local authorities.
