EUROPEAN COMMUNITIES (OFFICIAL CONTROL OF FOODSTUFFS) (APPROVED EXAMINERS) ORDER, 1998 I, Brian Cowen T.D., Minister for Health and Children, in exercise of the powers conferred on me by Section 3 of the European Communities Act, 1972 (No. 27 of 1972) hereby make the following Regulations for the purpose of giving full effect to Council Directive 89/397/EEC1 on the official control of foodstuffs and Council Directive 93/99/EEC2 on the subject of additional measures concerning the official control of foodstuffs. 1 OJ No. L186, 30.6.1987, p.23 2 OJ No. L290, 24.11.1993, p.14 1. This Order may be cited as the European Communities (Official Control of Foodstuffs) (Approved Examiners) Order, 1998. 2. The following class of person(
- s)listed hereunder are approved to analyse any samples of food taken by an authorised officer for the purposes of the European Communities (Official Control of Foodstuffs) Regulations, 1998. (
- i)Public Analyst located at a Public Analyst Laboratory in Ireland; (
- ii)Deputy Public Analyst located at a Public Analyst Laboratory in Ireland; (iii) Executive Analytical Chemist located at a Public Analyst Laboratory in Ireland; (
- iv)Consultant Microbiologist located at an Official Laboratory in Ireland; (
- v)Chief Laboratory Technologist located at an Official Laboratory in Ireland; (
- vi)Officers at or above the grade of "Scientific Officer", who are engaged in the task of analysis of food by the Radiological Protection Institute of Ireland. GIVEN under the Official Seal of Minister for Health and Children, this 3rd day of December 1998 Brian Cowen MINISTER FOR HEALTH AND CHILDREN EXPLANATORY NOTE Article 3 of the European Communities (Official Control of Foodstuffs) Regulations, 1998 ( S.I. No. 85 of 1998 ) empowers the Minister to approve a person or a class of person to analyse a controlled item for the purposes of the Regulations. This order approves a list of such classes of persons with effect from 9 December 1998.
