No. 555/1998 - Merchant Shipping (Training and Certification) (Stcw Convention States) Order, 1998 AmendmentsLeasuithe WHEREAS the Minister for the Marine and Natural Resources is satisfied that the Governments of those states, who are parties to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW Convention) which was adopted by the International Conference on Training and Certification of Seafarers on the 7th day of July, 1978, and as subsequently amended, provides for the holding of examinations for the grant of certificates of competency as deck officers or engineer officers on board ship; AND WHEREAS the Minister for the Marine and Natural Resources is satisfied that the certificates so granted are granted on such principles as to show qualifications of competency which are adequate qualifications for service in Irish-registered ships. Now therefore the Minister for the Marine and Natural Resources, in exercise of the powers conferred on him by section 7 (as amended by section 28 of the Merchant Shipping Act, 1992 (No. 2 of 1992) of the Merchant Shipping Act, 1947 (No. 46 of 1947), as adapted by the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983) and the Marine (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 301 of 1997 ), hereby order as follows: 1 Citation and commencement. 1. This order may be cited as the Merchant Shipping (Recognition of Certification) (STCW Convention States) Order, 1998. 2 Recognition of certificates. 2.

(1)The Minister may recognise a certificate issued to a deck officer or engineer officer by or under the authority of the Government of another state where that state is a party to the STCW Convention and where the Minister is satisfied - (
  1. a)that the requirements of the STCW Convention concerning standards of competence, the issue and endorsement of certificates and record keeping are fully complied with, and (
  2. b)that prompt notification will be given to the Department of the Marine and Natural Resources of any significant change in the arrangement for training and certification provided in compliance with the STCW Convention.
(2)In this Article - "STCW Convention" means the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers which was adopted by the International Conference on Training and Certification of Seafarers on the 7th day of July, 1978, and as subsequently amended by amendments which were - (
  1. a)adopted in 1991 and entered into force on 1st day of December, 1992, (
  2. b)adopted in 1994 and entered into force on the 1st day of January, 1996, and (
  3. c)adopted on the 7th day of July, 1995, by resolution 1 of the Conference (convened in London by the International Maritime Organisation) of Parties to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers; "the Minister" means the Minister for the Marine and Natural Resources.
